providing that the part of said area not having available water and
sewer, be taxed at a rate equal to 50% of that of other areas subject
to city taxes.

WHEREAS, The City of Salisbury has heretofore, on March 25, 1968,
passed an annexation resolution, being Resolution No. 104, annexing the
Northwood area, subject to certain terms and conditions, and

WHEREAS, the original annexation resolution provided in part that
upon the expiration of two years following the effective date of the annexa-
tion of Northwood Area, and not sooner than July 1, 1970, full city services
would be available and all property therein would be subject to taxation
by the City of Salisbury at the full rate of taxes, and

WHEREAS, due to unforeseen circumstances delays have occurred
which prevented water and sewer services from being available to the
entire Northwood Area, and

WHEREAS, it is deemed by the Council of The City of Salisbury
that a rate of 50% of the full city rate presently in existence would be fair
and equitable and in accordance with the intention of the original North-
wood Annexation Resolution.

Section 1. NOW THEREFORE, BE IT RESOLVED BY THE COUN-
CIL OF THE CITY OF SALISBURY, That the total levy of tax for prop-
erties in the Northwood Area, annexed by Resolution No. 104 and who do
not presently have available city water and sewer be and the same hereby
is set at the rate of 64½¢ per $100.00 of assessed evaluation of all property
subject to taxation for the fiscal year beginning July 1, 1970 and ending
June 30, 1971.

Section 2. NOW, THEREFORE, BE IT RESOLVED BY THE COUN-
CIL OF THE CITY OF SALISBURY, that this Resolution shall take effect
immediately upon its final passage and in all other respects said Resolution
No. 104 is hereby ratified and confirmed.

The above resolution was introduced and read and passed at the regu-
lar meeting of the Council of The City of Salisbury, held on the 27th day
of July, 1970.
