City equipment.

New Carrollton Charter Amendment No. 71-6

An amendment to the Charter of the City of New Carrollton, Prince
George's County, Maryland, deleting Section 15 entitled "Streets and Side-
walks/Borrowing Authority" relating to street improvements, authority
to borrow for and levy assessments for same, limiting the interest rate
for said borrowing to 6%; deleting Section 16, entitled "Same: Benefit
Assessments"; adding a new Section 15 entitled "Benefit Assessments,"
to limit the City's authority to levy special assessments to those cases in
which the Council obtains written approval of the owners of more than
50% of the property abutting a proposed assessable improvement; and
clarifying the authority and procedures for levying benefit assessments.

[SECTION 15. STREETS AND SIDEWALKS/BORROWING AU-
THORITY]

[(a.) Improvements; approval. The Mayor and Council of New Car-
rollton, a municipal corporation, is hereby empowered and authorized to
construct roadbeds, sidewalks, curbs, gutters and street improvements,
including the surfacing or paving of any alley, or any or all, in the City
of New Carrollton, Maryland, in such cases as it may determine the same
to be necessary for the public benefit, and for the benefit of the abutting
land and of the owners of the said abutting land, provided that before any
permanent street, sidewalk and/or curb improvement shall be made under
the provisions of this section, the Mayor and Council shall obtain from
more than fifty per centum of the property owners of record abutting
upon said street, sidewalk, alley, and/or curb their written approval of
said permanent improvement and/or improvements.]

[(b.) Notification. When the Mayor and Council of New Carrollton
shall nave determined to make roadbed, sidewalk, alley, curb, gutter and
street improvements, or all or any, in any street or alley in said Town, it
shall thereupon notify, as far as practicable, each owner of land abutting
upon said street, proposed to be improved, by depositing said notice in
the United States Post Office, addressed to such owner's last known address,
setting forth that on a certain day to be named therein, which day shall
be not less than one week after the mailing of said notices, that the Mayor
and Council of New Carrollton will meet to consider the kind and character
of roadbed, sidewalk, curb, gutter and street improvements or all or any,
to be laid, and notifying said owner to appear at said meeting, and express
his or her views on the question, if he or she so desires; that at said meet-
ing the Mayor and Council of New Carrollton shall hear any suggestions
of said owners and immediately thereafter, or within a reasonable number
of days, shall determine the character and kind of work to be done, which
determination shall be final and conclusive.]

[(c.) Borrowing power. To effectuate the improvements that are
provided for in this section, the Mayor and Council of the City of New
Carrollton are hereby authorized and empowered to borrow from time to
time on the credit of the Town, a sum or sums of money not to exceed
at any time, an amount equal to five (5%) per centum of the assessed
valuation of all real property within said Town, and to issue, renew, or
re-issue notes, bonds, or certificates of indebtedness therefor, which shall
be payable within not to exceed ten years from the date of issuance, with
interest not to exceed the rate of six per centum per annum, payable semi-
