Capital Park and Planning Commission; to provide that the County
Council for Montgomery County may, in its discretion, designate
the Chairman or Vice-Chairman of the Commission to serve on a
fulltime basis; to authorize a supplementary salary for such member
and to designate a Montgomery County member of the Commis-
sion for the position of Chairman or Vice Chairman of the Com-
mission; to provide for Council designation over the disapproval
of the County Executive by a vote of five of its members; to
authorize the County Council or its designee to interview appli-
cants for appointment to the Commission; and to require appointees
to the Commission to file an annual financial statement with the
County Council, and generally relating thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 70-6, 70-7, 70-8, 70-9, 70-10 and 70-18 (a) and (c)
of the Montgomery County Code 1965, as amended, being Article 16
of the Code of Public Local Laws of Maryland, title "Montgomery
County," subtitle "Maryland-National Capital Park and Planning
Commission," and Sections 59-2, 59-3, 59-4, 59-5, 59-6 and 59-14(a)
and (c) of the Code of Public Local Laws of Prince George's County
(1963 Edition, as amended), being Article 17 of the Code of Public
Local Laws of Maryland, title "Prince George's County," subtitle
"Maryland-National Capital Park and Planning Commission," be and
are hereby repealed and re-enacted, with amendments, to read as fol-
lows :
70-6 (59-2). Composition; appointment and qualifications of
members.
The Commission shall be composed of ten members, five of whom
shall be residents of Montgomery County and five of whom shall
be residents of Prince George's County. Of the members of the
Commission for FROM each county, not more than three shall be
members of the same political party. All members shall be persons of
ability, experience and integrity and shall not be selected as represent-
ing or supporting any special interest or interests. All members of the
Commission to be appointed from Prince George's County shall be
appointed by the governing body of that county. All members of
the Commission to be appointed from Montgomery County shall be
appointed by the County [Executive subject to the confirmation of
the County] Council subject to the approval of the County Execu-
tive, as provided herein. Upon appointment, the name of the
appointee shall be delivered within three days to the County Execu-
tive who within thirty days thereafter shall either approve or dis-
approve the appointment. In the event that the County Executive
disapproves an appointment he shall return it to the Council with
the reasons for his disapproval stated in writing. The Council may,
by the affirmative vote of five of its members, appoint a member
of the Commission over the disapproval of the County Executive.
Any appointment which has not been disapproved by the County
Executive in the manner provided herein shall be deemed to have
been confirmed. In Montgomery County, the County [Executive]
Council shall be required to select [his] their ITS respective appoint-
ments or reappointments from a list of applicants. Such list shall be
open to the public at all times and shall be completed at least three
weeks prior to actual appointment or reappointment. In the event that
the County [Executive] Council does not appoint any individual
