700E.

(a)    The Division of Correction is authorized to establish an "ex-
tended work release program" under which inmates sentenced to the
jurisdiction of the Division of Correction for desertion or non-support
of wife, children or destitute parents, may be granted the privilege
of leaving actual confinement for the purposes of working at gainful
employment [within this State] and/or to live in a noninstitutional
environment [within this State]. Such program may also include,
under appropriate conditions, release of an inmate to live at home
under intensive supervision by the Division of Parole and Probation.

(b)    It shall be the duty of the Division of Parole and Probation,
when an inmate convicted of desertion or nonsupport of wife, chil-
dren, or destitute parents, is first received at an institution of the
Division of Correction, to cause to be made such investigation as
may enable the Commissioner of Correction, or his designee, to de-
termine the advisability of placing said inmate in the "extended
work release program." The Commissioner of Correction, or his de-
signee, after reviewing the results of said investigation may approve,
disapprove or defer action as to any particular inmate. In the event
of approval, the Commissioner or his designee, shall adopt a plan for
said inmate which shall contain such terms and conditions as may
be necessary and proper. Such plan shall be signed by the inmate
prior to his participation in the program. Such plan may be condi-
tioned upon the inmate's agreement to waive his right to contest ex-
tradition proceedings.
At any time after approval has been granted,
it may be revoked for any reason by the Commissioner.

(c)    In addition to whatever other terms and conditions are con-
tained in the plan, the plan may provide:

1.    That the inmate work at gainful employment [within the
State] during necessary and reasonable hours with provision for
disposition of earnings towards maintenance and support of family
and to reimburse the State for the inmate's room and board; or

2.    That the inmate live in a controlled, but noninstitutional en-
vironment, under intensive supervision by the Division of Parole
and Probation with disposition of earnings for support and main-
tenance of his family and room and board for himself; or

3.    That in special cases where it is determined that the general
welfare and best interest of the inmate's family will be served, and
to insure family unity and more effective rehabilitation after expira-
tion of sentence, the inmate live at home under intensive supervision
by the Division of Parole and Probation with disposition of earnings
for support and maintenance of himself and his family.
