[Any person who wilfully instigates, engages in, or in any way
furthers any act of cruelty to any animal, or any act tending to pro-
duce such cruelty, or by any act, conduct, neglect or omission wilfully
causes, permits or suffers any animal to undergo any torture or
cruelty shall be deemed guilty of a misdemeanor and shall be pun-
ished by a fine not exceeding $1,000.00, or by imprisonment not to
exceed 90 days, or both.]
Any person who (1) overdrives, overloads, deprives of necessary
sustenance, tortures, torments, cruelly beats, mutilates or cruelly
kills; or (2) causes, procures, OR authorizes, requests or encourages
these acts; or (3) having the charge or custody of an animal, either
as owner or otherwise, inflicts unnecessary suffering or pain upon
the animal, or unnecessarily fails to provide the animal with proper
food, drink, air, light, space, shelter or protection from the weather,
is guilty of a misdemeanor and shall be punishable by a fine not ex-
ceeding $1,000 or by imprisonment not to exceed 90 days, or both.
62.
[The words "torture or cruelty" shall be held to include every-
thing whereby unjustifiable physical pain, suffering or death is
caused or permitted,] The words "torture," "torment," and "cruelty"
means every act, omission, or neglect whereby unnecessary or un-
justifiable physical pain or suffering is caused or permitted, and the
word "animal" [shall be held to include] means every living creature
except [men] man.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

AN ACT to repeal and re-enact, with amendments, Sections 700A
through 700E, inclusive, of Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume and 1971 Supplement),
title "Crimes and Punishments," subtitle "III. Places of Reforma-
tion and Punishment," subheading "Division of Correction," to
provide that prisoners be permitted work release and other leave
privileges both within and without this State and to make certain
corrections.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 700A through and including Section 700E of Article 27
of the Annotated Code of Maryland (1971 Replacement Volume and
1971 Supplement), title "Crimes and Punishments," subtitle, "III.
Places of Reformation and Punishment," subheading "Division of
Correction," be and they are hereby repealed and re-enacted with
amendments and all to read as follows:
