AN ACT to repeal and re-enact, with amendments, Section 122(b)
of Article 43 of the Annotated Code of Maryland (1971 Replace-
ment Volume), title "Health," subtitle "Practitioners of Medi-
cine," to exempt individuals to whom duties are delegated by
licensed physicians from the necessity of obtaining a license to
practice medicine, AND GENERALLY RELATING THERETO.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 122(b) of Article 43 of the Annotated Code of Mary-
land (1971 Replacement Volume), title "Health," subtitle "Practi-
tioners of Medicine," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
122.
(b) The following persons may practice without a license, but
subject to rules, regulations and orders of the Board and Commis-
sion:
(1) A resident, physician, intern, or student, or equivalents at
any hospital or office of physician who is engaged in hospital, dis-
pensary, or similar duties.
(2) A physician licensed by and residing in another jurisdiction
when engaged in consultation with a physician in this State.
(3) A commissioned surgeon of any of the Armed Forces of the
United States, the United States Public Health Service Hospitals or
the Veterans Administration while engaged in the performance of
duties incident to his commission.
(4) A physician who resides in a neighboring jurisdiction who
is authorized under the laws of that jurisdiction to practice medi-
cine therein and whose practice extends into this State, provided the
physician does not open an office or have a regularly appointed place to
meet patients within this State and further provided that the
same privileges are extended to physicians from this State by the
neighboring jurisdiction.
(5) An individual to whom duties are delegated by a licensed
physician, including, but not limited to, any individual registered,
certified or licensed to practice any other HEALTH profession de-
fined by law, in accordance with regulations to be promulgated by
the Board.
(i) The Board, before promulgating regulations, shall invite and
consider proposals from the individuals or groups which are to be
regulated INDIVIDUALS OR HEALTH GROUPS WHICH COULD
BE AFFECTED.
(II) WHERE DUTIES TO BE DELEGATED FALL INTO
AN AREA OF PRACTICE ALREADY CONTROLLED BY A
LEGALLY CONSTITUTED BOARD, REGULATIONS REGARD-
ING THESE DUTIES SHALL BE ISSUED JOINTLY BY THE
BOARD OF MEDICAL EXAMINERS AND THE OTHER
LEGALLY CONSTITUTED BOARD. WHERE AGREEMENT
