AN ACT to add new Sections 159, 159A, 159B, 159C, 159D and
159E to Article 56 of the Annotated Code of Maryland (1968
Replacement Volume), title "Licenses," to follow immediately
after Section 158 thereof and to be under the new subtitle "Out-
door Musical Festivals," to provide for the issuance of permits,
license and license taxes for outdoor musical festivals IN CER-
TAIN COUNTIES and providing penalties for the violation there-
of , AND RELATING TO THE DUTIES OF CERTAIN PUBLIC
OFFICIALS IN RELATION THERETO.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 159, 159A, 159B, 159C, 159D and 159E be and
they are hereby added to Article 56 of the Annotated Code of Mary-
land (1968 Replacement Volume), title "Licenses," to follow imme-
diately after Section 158 thereof and to be under the new subtitle
"Outdoor Musical Festivals," and to read as follows:
Outdoor Musical Festivals
159.
(a) "Outdoor musical festival" means any group or group of per-
sons participating in musical entertainment in open spaces and not
in a permanent structure.: AND NOT ON PUBLICLY OWNED
PROPERTY.
(b) "Promoter" means the organizer, operator, producer, or the
person or persons, or corporation staging the outdoor musical fes-
tival; and the owner, tenant, and OR lessee of the land upon which
the outdoor musical festival is performed. THE TERM SHALL
NOT INCLUDE THE STATE OR ANY POLITICAL SUBDIVI-
SION.
(c) "Spectator" means a MEMBER OF A gathering of 1,000 or
more persons who pay a consideration ARE IN ATTENDANCE
for the purpose of viewing and/or hearing the outdoor musical
festival.
159A.
(a) No promoter shall hold or conduct any outdoor musical fes-
tival where spectators will be present without first obtaining permits
from the State Board of Health, or its successor, DEPUTY STATE
HEALTH OFFICER FOR THE COUNTY and the Superintendent
of the State Police.
(b) The State Board of Health shall not issue a permit A PER-
MIT SHALL NOT BE ISSUED until the following provisions are
met:
(1) The promoters post case bond in the amount of AN AMOUNT
TO BE DETERMINED BY THE HEALTH OFFICER NOT TO
EXCEED $50,000, and
(2) The promoters establish adequate sanitation , MEDICAL and
health facilities that are in accordance with the rules and regula-
