VISIONS and making the effect of this Act subject to a certain
contingency.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3-4 (b) of Article 33 of the Annotated Code of Maryland
(1971 Replacement Volume and 1971 Supplement), title "Election
Code," subtitle "Registration of Voters—General Provisions," be and
it is hereby repealed and re-enacted, with amendments, AND THAT
NEW SECTIONS 3-4 (C) AND (D) BE AND THEY ARE HERE-
BY ADDED TO THE SAME ARTICLE, TITLE AND SUBTITLE,
TO FOLLOW IMMEDIATELY AFTER SECTION 3-4 (B) THERE-
OF, ALL to read as follows:
3-4.
(b) The constitutional qualifications of voters are the following;
each one of which is applicable to every voter:
(1) Citizen of United States;
(2) Age of twenty-one years or older, except for federal offices
when the age shall be eighteen years or older;
(3) Resident of State for six months THIRTY DAYS preceding
general election;
(4) Resident of county or legislative district of Baltimore City,
in which he may offer to vote, as of the time for closing of registra-
tion, next preceding the election;
(5) Not twice convicted [of larceny or] of an infamous crime,
unless pardoned by the Governor;
(5) NOT CONSTITUTIONALLY REGULATED OR PROHIB-
ITED BY SUBSECTIONS (C) OR (D) OF THIS SECTION;
(6) Not the subject of any guardianship proceedings; nor a lunatic
nor a person who is non compos mentis;
(7) (6) Not convicted of buying or selling votes.
(C) NO PERSON SHALL BE REGISTERED AS A QUALI-
FIED VOTER IF HE HAS BEEN TWICE CONVICTED OF AN
LARCENY OR OTHER INFAMOUS CRIME, UNLESS PAR-
DONED BY THE GOVERNOR.
(D) NO PERSON SHALL BE REGISTERED AS A QUALI-
FIED VOTER IF HE IS UNDER CARE OR GUARDIANSHIP
FOR MENTAL DISABILITY.
Sec. 2. And be it further enacted, That the effect of this Act
shall be subject to the adoption by the voters of Maryland of a
Constitutional amendment to Section 2 of Article I of the Consti-
tution of Maryland having the effect of providing that the General
Assembly by law may regulate or prohibit the right to vote of a
person convicted of infamous or other serious crime or under care
or guardianship for mental disability, and providing for the repeal
of the constitutional prohibition of the right to vote for these persons.
If such amendment to the Constitution of Maryland is adopted, this
Act shall take effect upon the official Proclamation of the Governor
of Maryland certifying the adoption of the Constitutional amendment.
