Any person, individual, organization, group association, partner-
ship, co-partnership, or OF any combination thereof, who solicits
funds, money or other goods and services, for any charitable organi-
zation for any remuneration from anyone in this State, shall apply to
the Secretary of Licensing and Regulation for an annual license. Each
licensee shall receive an identifying number. The fee charged for this
license is one hundred dollars per annum.

Each licensee shall file with the Secretary of Licensing and Regula-
tion an annual report setting forth the number or organizations it
has collected for, the total amounts collected and the amount of funds
turned over to the charitable organization.

284.

Every licensee shall have a written contract with the charitable
organization it is to collect for, and shall file a copy of this contract
with the Secretary of Licensing and Regulation within ten (10) days
after it is signed by the charitable organization. It shall be the re-
sponsibility of the licensee to ascertain that the contract is filed
within the ten-day period. The licensee shall not solicit or attempt to
solicit until the contract is filed. If every ANY solicitation is done
before the contract is signed or if the contract is not filed within the
ten-day period, the licensee shall pay a penalty of one hundred
dollars per day, payable to the Secretary of Licensing and Regulation.

No licensee, by contract or otherwise, shall substitute his interest
with that of the charitable organization for the purposes of collecting
any funds, money, or other goods and services.

286.

No licensee shall enter into any contract or agreement with any

charitable organization for any commission or other remuneration
that exceeds (ten percentum) 10% of the total funds, money or other
goods and services collected.

ANY COMMISSION OR OTHER REMUNERATION SHALL
BE SUBJECT TO THE REGULATION OF THE SECRETARY
OF LICENSING AND REGULATION.

287.

Any licensee in violation of this subtitle is guilty of a misdemeanor
and shall be punished by a fine of not more than one thousand dollars
($1000) or by imprisonment for not more than eighteen (18) months
or both fine and imprisonment.
