Sec. 2. And be it further enacted, That this Act shall take effect
on July 1, 1972.

CHAPTER 513
(House Bill 453)

AN ACT to add new Section 36A to Article 78 of the Annotated Code
of Maryland (1969 Replacement Volume), title "Public Service
Commission Law," subtitle "Public Service Companies," to follow
immediately after Section 36 thereof, to require certain locomotives
operating under IN EXCESS OF a certain speed to have certain
equipment within a certain time period, to require maintenance
of certain records and relating to certain duties of the Public
Service Commission in relation thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 36A be and it is hereby added to Article 78 of the
Annotated Code of Maryland (1969 Replacement Volume), title
"Public Service Commission Law," subtitle "Public Service Compan-
ies," to follow immediately after Section 36 thereof and to read as
follows:

36A.

(a)    The General Assembly of the State of Maryland finds that the
safe operation of steam, diesel, electric or otherwise propelled locomo-
tives within the State requires that all steam, diesel, electric or other-
wise propelled locomotives operated in excess of fifteen miles per
hour by common carriers by rail within the State be equipped with
fully operable speedometers within view of the engineer or operator of
such THE locomotive.

(b)    No railroad locomotive shall be operated in excess of fifteen
miles per hour in this State without a speedometer or speed recorder
functioning correctly within four miles per hour within the view of
the engineer or operator of each THE locomotive.

(c)    A railroad is in compliance with the provisions of this section
if, by the first day of October 1972, it has at least one-third of its loco-
motives equipped with speed indicators or speed recorders as herein-
above provided and if, by the first day of October 1973, an additional
one-third of said THE locomotives shall be so equipped, and if, by the
first day of October 1974, the remainder of its locomotives shall be so
equipped.

(d)    Locomotives operated or used exclusively within designated
yard limits in switching or transfer service, AND EXISTING MU
CARS WHICH DO NOT PRESENTLY HAVE SPEEDOMETERS
need not be equipped in accordance with the provisions of this section.
