AN ACT to add new Section 1A to Article 17 of the Annotated Code
of Maryland (1966 Replacement Volume), title "Clerks of Courts,"
subtitle "General Duties of Clerks," to follow immediately after
Section 1 thereof, and to repeal and re-enact, with amendments,
Section 8 of Article 54 of said Code (1971 Supplement), title "Hall
of Records," subtitle "Hall of Records Commission," establishing a
procedure for destruction of certain books and papers by Clerks
of Court in conjunction with the Hall of Records and the
established procedures for such destruction, and correcting certain
references therein.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 1A be and it is hereby added to Article 17 of the
Annotated Code of Maryland (1966 Replacement Volume), title
"Clerks of Courts," subtitle "General Duties of Clerks," to follow
immediately after Section 1 thereof, and to read as follows:

The clerk, UNDER SUCH RULES AND REGULATIONS AS
MAY BE PROMULGATED BY THE COURT OF APPEALS, may
destroy pleadings, papers and files in his custody which, because of
their character, serve no useful purpose in being retained, following
the procedures established pursuant to this Section. Before any
pleadings, papers or files are destroyed, the proposed destruction
must be approved in writing by the Resident Circuit Court Judges
ADMINISTRATIVE JUDGE of the county or city, OR BY A
MAJORITY OF THE RESIDENT CIRCUIT COURT JUDGES
OF THE COUNTY OR CITY, and the records must be disposed of
in accordance with the provisions of Sections 7, 8, and 10 of Article
54 of the Annotated Code, as amended from time to time.
Sec. 2. And be it further enacted, That Section 8 of Article 54 of
said Code (1971 Supplement), title "Hall of Records," subtitle "Hall
of Records Commission," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

If the Commission shall decline to accept any original papers,
official books, records, documents or files offered to it under the
provisions of Section 7, then the custodian thereof, with the written
approval of the Board of Public Works, is authorized and empowered
to destroy the same. After such records are destroyed, the custodian
thereof shall file with the Hall of Records a list of all papers, books,
