Sec. 2. And be it further enacted, That new Section 371A be and it
is hereby added to Article 27 of this Code (1971 Replacement Vol-
ume) , title "Crimes and Punishments," subtitle "Crimes and Punish-
ments," subheading "Lotteries," to follow immediately after Section
371 thereof, and to read as follows:

Article 27
371A.

The provisions of this subheading relating to lotteries shall
not apply to the State lottery system established in Article 88D of
this Code.

SEC. 3. And be it further enacted, That this Act shall take effect
contingent upon the adoption of an amendment to Section 36 of

Article III of the Constitution of Maryland as enacted by Chapter......

of the Acts of 1972 (S.B......... or H.B.........); and if Section 36 of

Article III of the Constitution is not amended by Chapter........above,

then this Act shall become null and void without the necessity of
further action by the General Assembly.

Sec. 4. And be it further enacted, That, subject to the provisions
of Section 3 above, this Act shall take effect January 1, 1973.

CHAPTER 366
(House Bill 687)

AN ACT to amend the Declaration of Rights of the Constitution of
Maryland, to add new Section ARTICLE 46, to state that equality
of rights under the law shall not be abridged or denied because of
sex.

Section 1. Be it enacted by the General Assembly of Maryland,
(Three-fifths of all the members elected to each of the two houses
concurring), That new Section ARTICLE 46 is hereby proposed to
the Declaration of Rights of the Constitution of Maryland, the same,
if adopted by the legally qualified voters of the State, as herein pro-
vided, to become part of the Constitution of Maryland, all to read
as follows:

46.

Equality of rights under the law shall not be abridged or denied
because of sex.

Sec. 2. And be it further enacted, That the aforegoing sections
hereby proposed as amendments to the Constitution of Maryland, at
the next general election to be held in this State in November 1972,
shall be submitted to the legal and qualified voters thereof for their
adoption or rejection in pursuance of directions contained in Article
14 of the Constitution of this State, and at the said general election,
