CHAPTER 443
(Senate Bill 292)

AN ACT to add new Section 361 to Article 43 of the Annotated Code
of Maryland (1965 Replacement Volume and 1970 Supplement),
title "Health," subtitle "Funeral Directors and Embalmers," to
follow immediately after Section 360 thereof, to provide for a
license to operate any funeral establishment, to establish require-
ments for the license, to provide for the revocation or suspension
of the license, to provide for the revocation or suspension of the
individual license of an applicant for the establishment license, and
to specify the penalty for operating without a license.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 361 be and it is hereby added to Article 43 of the
Annotated Code of Maryland (1965 Replacement Volume and 1970
Supplement), title "Health," subtitle "Funeral Directors and Em-
balmers," to follow immediately after Section 360 thereof, and all
to read as follows:

361.

(a)  As used in this subtitle, the term "Funeral Establishment"
means any building, structure or premises from which is conducted
the business of funeral directing and embalming.

(b)  No funeral establishment will be used for the conduct of the
business of funeral directing and embalming unless and until the
establishment obtains a valid license pursuant to the provisions of
this subtitle. This license is in addition to the Funeral Director and
Embalmer license required of individuals engaged in that business.

(c)  An application for a funeral establishment license will be
signed by a person who holds an individual license issued under the
provisions of this subtitle. The applicant must be the owner, or one
of the owners, or a full time employee of the establishment to be
licensed.

(d)  A funeral establishment license will be issued by the State
Board of Funeral Directors and Embalmers only when the Board is
satisfied that the establishment meets the requirements of all appli-
cable State and local laws and that the establishment is to be operated
by one or more licensed Funeral Directors and Embalmers in accord-
ance with this subtitle.

(e)  The fee for a funeral establishment license is $25.00 per year,
to be paid to the State Board of Funeral Directors and Embalmers.

(f)  A funeral establishment license is effective when issued, up to
and including the first day of May next following issuance, unless
sooner suspended or revoked.

(g)   The State Board of Funeral Directors and Embalmers has the
power to suspend or revoke at any time a funeral establishment
license for any of the causes set forth in Section 354 of this subtitle.
In addition, the Board has the power to suspend or revoke the license
issued to the individual who signed the application for the funeral
establishment license, if the Board finds from the evidence before
it that this individual knew, or should have known of the existence
