legislatures of Maryland, Pennsylvania, Virginia and West Virginia,
and by the Congress on behalf of the United States and the District
of Columbia. The compact shall be signed and sealed in seven (7)
identical original copies by the respective chief executives of the
signatories. One such copy shall be filed with the Secretary of State
of the signatories or in accordance with the laws of the signatory
in which the filing is made, and one copy shall be filed and retained
in the archives of the Commission upon its organization.
Sec. 3. And be it further enacted, That Sections 407 and 408 of
Article 43 of the Code, (1965 Replacement Volume and 1970 Supple-
ment), title "Health," subtitle "Water, Ice and Sewerage," be and
they are hereby repealed, so that in accordance with the provisions
of Section 15.15 of the Potomac River Basin Compact enacted by
Section 2 of this Act, the compact establishing the Interstate Com-
mission on the Potomac River Basin is repealed, and any interests
of the State of Maryland in said Commission and its assets are
authorized to be transferred to the Potomac River Basin Commission.
Sec. 4. And be it further enacted, That subject to other provi-
sions in this Act covering the application and effect of the Potomac
River Basin Compact, particularly those in Section 126 (15.21
thereof), this Act, except for Section 3 hereof, shall take effect on
July 1, 1971. The provisions of Section 3 of this Act shall take effect
at the times and on the occurrence of the events specified in Section
15.15 of the compact enacted by Section 2 hereof.

AN ACT to add new Sections 763 through 768, inclusive, to Article
66C of the Annotated Code of Maryland, title "Natural Re-
sources," subtitle "In General," subheading "Department of
Natural Resources," to follow immediately after Section 762 there-
of, and to be under the new subtitle "Power Plant Siting," to es-
tablish an Environmental Trust Fund from a surcharge on gener-
ated kilowatts KILOWATT HOURS of electric energy to be used
to underwrite a power plant environmental research and site eval-
uation program and to insure long rang and timely planning for
power plant site selection and acquisition, to strengthen the State
of Maryland's capability to define and manage a power plant en-
vironmental research program, to provide for the exercise of emi-
nent domain and potential power plant site ownership by the
Secretary of Natural Resources; and to exempt from local zoning
certain sites; to add new Section 5A to Article 66C of the Anno-
tated Code of Maryland, title "Natural Resources," subtitle "In
General," subheading "Department of Natural Resources," to as-
sign responsibility to the Secretary of Natural Resources on appli-
cations to the Public Service Commission for certificates of public
convenience and necessity associated with power plant construc-
tion; to repeal and re-enact Section 706 of Article 43 of the Anno-
