Sec. 9. And be it further enacted, That it is the legislative in-
tention to provide financial assistance for capital expenses which
may be incurred after the effective date of this Act in the acquisition
of land and the construction of public junior or community colleges.

Sec. 10. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 351
(Senate Bill 453)

AN ACT to repeal and re-enact, with amendments, Section 3 of
Article 64A of the Annotated Code of Maryland (1968 Replace-
ment Volume and 1970 Cumulative Supplement), title "Merit
System," to add new Section 9E to said Article of the Code to
follow immediately after Section 9D thereof; to repeal Sections 2-6
and 2-6A of Article 33 of the Annotated Code of Maryland (1971
Replacement Volume), title "Election Code," subtitle "Election
Boards and Employees," and to enact in lieu thereof a new Section
2-6 therein; and to repeal and re-enact, with amendments, Sections
1-1 (a) (3), 3-10 (a) and 16-8 (a) of Article 33 of the Annotated
Code of Maryland (1971 Replacement Volume), title "Election
Code," subtitles "Definitions," "Registration of Voters—How and
by Whom Conducted," and "Voting Machines," correcting errors
therein and placing under the jurisdiction of the Secretary of
Personnel all continuously employed permanent employees, both
full-time and part-time, of the boards of supervisors of elections
in the various subdivisions of the State; establishing procedures
for the examination and qualification for eligibility for service in
the classified service of the State of all employees of the various
boards of supervisors of elections; PROVIDING FOR THE EX-
EMPTION OF CERTAIN COUNTIES WHICH ELECT TO
MAINTAIN A LOCAL MERIT SYSTEM FOR EMPLOYEES
OF BOARDS OF SUPERVISORS OF ELECTIONS; prohibiting
certain political activities of CERTAIN employees of the various
boards of supervisors of elections; and relating generally to the
employment status of said employees.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3 of Article 64A of the Annotated Code of Maryland
(1968 Replacement Volume and 1970 Cumulative Supplement), title
"Merit System," be and it is hereby repealed and re-enacted, with
amendments, and that new Section 9E be and it is hereby added to
said Article of the Code, to follow immediately after Section 9D
thereof, and all to read as follows:

The following positions shall not be included in the classified serv-
ice, namely: those held by officers elected by popular vote and officers
whose appointment and election is provided by the Constitution, in-
cluding deputy clerks provided for by the Constitution, [Articles 4,
