DAY THE WATER WAS PLACED IN THE CONTAINER,
TO REMOVE OBSOLETE PROVISIONS AND TO CLARIFY
THE LANGUAGE THEREIN.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 400 of Article 43 of the Annotated Code of Maryland
(1965 Replacement Volume) title "Health," subtitle "Water, Ice
and Sewerage," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
400.
The State [Board] Department of Health and Mental Hygiene
shall have supervision and control over the surroundings of any
source from which either surface or underground water, for potable
purposes, is collected for delivery in containers; and it shall also
assume jurisdiction over the method of collecting, bottling and
delivering [such waters] water. [After April 16, 1914, no such
waters] No water shall be collected, bottled or delivered until a
written permit [so] to do so has been issued by the [State Board of
Health] Department to the owner of [such] the supply. No [such]
permit will be issued if the [State Board of Health] Department
determines that [said] the water is in any way injurious to the
public health. Corporations, companies and persons handling potable
water[s], shipped from points outside of the State of Maryland [,]
shall receive permits to sell water[s] only upon presentation to the
[State Board of Health] Department of a permit issued by the
state board of health of the state from which the water is collected,
stating that the source of [such] the water supply and the method
of handling the water, as practiced within the limits of that state,
are such as not to be prejudicial to the public health, and that [said]
the water is allowed to be sold within the limits of the state issuing
[said] the permit. Nothing herein provided shall, however, prevent
the [State Board of Health] Department from prohibiting the use
of such water shipped from another state, if in its judgment, [said]
the water is shown by analysis to be unfit for potable purposes or if
its quality in any way is injured by such handling as may be accorded
to it after arriving within this state. No potable water to be bottled
and sold in the State of Maryland shall be placed in containers made
of paper or plastic coated paper. All containers having potable water
in them and offered for sale in the State shall be marked with a stamp
clearly indicating the month and day the water was placed in the
container. POTABLE WATER PACKAGED AND SOLD IN THE
STATE IN INDIVIDUAL CONTAINERS MADE OF PAPER OR
PLASTIC-COATED PAPER SHALL BE MARKED WITH A
STENCIL OR STAMP CLEARLY INDICATING THE MONTH
AND DAY THE WATER WAS PLACED IN THE CON-
TAINER.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
