for Worcester County, and shall be charged therefor fifteen percent
(15%) less than the retail price of the liquor control board for such
liquors and wines. No license shall be issued unless said hotel or
restaurant is operated in a clean and sanitary manner and is equipped
with proper rest-room facilities. All license fees shall go to the
general funds of the county except where the licensed premises are
in an incorporated town in which event seventy-five percent of the
funds shall go to the incorporated town.

Sec. 2. And be it further enacted, That this Act is hereby
declared to be an emergency measure and necessary for the immedi-
ate preservation of the public health and safety and having been
passed by a yea and nay vote supported by three-fifths of all the
members elected to each of the two houses of the General Assembly,
the same shall take effect from the date of its passage.

CHAPTER 154
(House Bill 513)

AN ACT to repeal and re-enact, with amendments, Section 149 (a)
of Article 2B of the Annotated Code of Maryland (1968 Replace-
ment Volume), title "Alcoholic Beverages," subtitle "Boards of
License Commissioners," to specify the term of office for the license
commissioner in Frederick County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 149(a) of Article 2B of the Annotated Code of Maryland
(1968 Replacement Volume), title "Alcoholic Beverages," subtitle
"Boards of License Commissioners," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

149.

(a) In Frederick County, the Governor shall appoint a license
commissioner for Frederick County, who, at the time of his appoint-
ment shall be a resident and taxpayer of Frederick County and shall
have resided in said county for not less than five years next preceding
his appointment and be not less than thirty years of age. He shall
serve for a term ending May 1, 1975, and thereafter, the term of
office shall be four years.
During his term of office, he shall not hold
any other position of trust or profit under the laws of the United
States or the State of Maryland. In addition to his salary, the
County Commissioners shall provide him with such sum as may be
necessary to cover office and other expenses not to exceed three thou-
sand dollars ($3,000.00) per annum from the licensing of alcoholic
beverages establishments. The commissioner so appointed shall con-
stitute the board of license commissioners for Frederick County.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
