public disclosure statements with the Secretary to the County Council
and submitting said amendment to the qualified voters of Anne Arundel
County, Maryland, for their adoption or rejection, and matters gen-
erally related thereto.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Section 1002A of
Article X of the Charter of Anne Arundel County, Maryland, titled,
"Miscellaneous" (as enacted by Bill No. 115-69), be, and it is hereby
repealed and re-enacted, with amendments, to read as follows:
Section 1002A
(a) Public confidence in the government of Anne Arundel County
being dependent not only upon the integrity of its public officials, but also
upon the public availability of sufficient information to dispel uncertainty
as to such integrity, it is the intent that this Section be liberally con-
strued. Any reasonable uncertainty as to the necessity for disclosing any
of the information hereinafter required shall be resolved in favor of its
disclosure. No such disclosure shall be construed as an admission or
representation of any tax liability, or of any enforceable or contractual
rights.
(b) (1) Within thirty (30) days after December 3, 1970 or within
thirty (30) days after assuming office, the following public officials of
Anne Arundel County shall file with the [Clerk of the Circuit Court
for Anne Arundel County] Secretary to the County Council the state-
ments required by this Section:
(A) Members of the County Council
(B) The County Executive
(C) Heads of Offices and Departments as well as other Executive
positions appointed by the County Executive or the County Council
(D) Members of the Board of Appeals
(E) Members of the Planning Advisory Board
(F) Members of the Housing Authority
(2) The County Council may, by ordinance not inconsistent with
these provisions, extend the reporting requirements of this section to
any other position compensated in whole or in part by County funds,
or to any other non-compensated County appointive position if, in its
judgment, the duties or responsibilities of that position are deemed to be
comparable to those of the positions specifically set forth herein, or if the
sensitivity of location or other attributes of the position indicate that it
would serve the public interest to be included in such extension, initial
filing of statements pursuant to such ordinance shall take place within
thirty (30) days after its effective date.
(3) A new statement shall be filed every six (6) months thereafter
during his or her tenure in office, and a final statement within thirty (30)
days after termination. Every such statement shall be under oath, based
upon personal knowledge and subject to penalties for perjury. It shall be
maintained by the Clerk of the Circuit Court for Anne Arundel County
SECRETARY TO THE COUNTY COUNCIL for public inspection or
copying at reasonable cost to any member of the public requesting same.
