County Council and the Board of Education acting jointly, with regard
to said school projects, to expend said bond proceeds for said school proj-
ects in such manner as will best achieve the stated objectives of this Act
and of the Capital Improvement Budget of Wicomico County, Maryland.
Within the aforesaid limitations, authority is hereby delegated to the
department or commission, charged by law with operation and administer-
ing any one of the above-listed public improvements projects, to program
the expenditures of its share of said bond proceeds in such manner as
will best achieve the stated objectives of this Act, and of the Capital
Improvement Budget of Wicomico County above referred to.
Section 6. AND BE IT FURTHER ENACTED, that the County Coun-
cil of Wicomico County, Maryland, shall designate two (2) of its members,
and the Board of Education of Wicomico County shall designate two (2)
of its members, who shall serve on the School Building Commission. The
four (4) persons so designated shall then select three (3) representative
citizens of Wicomico County, and the seven (7) persons so designated
shall constitute the "Wicomico County School Building Commission of
1970." The jurisdiction of said School Building Commission shall involve
only those projects regarding the Wicomico County School System as
referred to herein. Said Commission, with regard to the above-mentioned
projects, is authorized to make a full and detailed study of the type of
construction and plans of the buildings constituting the school projects
enumerated herein, the type and amount of equipment necessary therefor,
and shall make a detailed study of the cost thereof and obtain such other
data as in the opinion of said Commission is required to properly carry
out the duties hereby assigned to the Commission under the provisions
hereof, and shall from time to time make recommendations concerning
the same to the County Council and the Board of Education, which
recommendations said joint Boards shall consider, but which shall be
advisory only and shall not bind said Boards in any action which they
may take. In the event of a vacancy on the Commission by death, resigna-
tion, or otherwise, such vacancy shall be filled by the Board or Boards, and
in the manner, by which the member of the Commission whose vacancy
is being filled was originally selected.
Section 7. AND BE IT FURTHER ENACTED, that the various pro-
visions of this Act shall be regarded as separate and severable, and should
any section, sentence, clause, or provision thereof be held invalid or un-
constitutional for any reason, the validity of the remaining parts hereof
shall not be affected thereby.
Section 8. AND BE IT FURTHER ENACTED, that this Act, having
been passed by the County Council of Wicomico County at its Legislative
Session of February, 1970, shall take effect April 1, 1970, unless a proper
petition for referendum thereof shall be validly filed prior to said date, in
which event this Act shall not take effect until the expiration of thirty (30)
days following approval of this Act by a majority of the qualified voters
of the County voting in any such referendum.
