Be It Enacted by the County Council for Montgomery County, Mary-
land, that—
Section 1. Section 24-47 of Chapter 24, titled "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:
24-47. Finding by Council that road no longer necessary and no damage
will be sustained.
No road or right of way may be abandoned and closed unless the
Council shall find that the evidence of record clearly indicates that the
road or right of way is no longer necessary for present or anticipated
future public use and that no damage will be sustained by any person
other than persons making the application or consenting to the abandon-
ment and closing.

An Act to authorize and empower the County Council of Wicomico
County, Maryland, to borrow on the faith and credit of Wicomico
County, an amount not exceeding Two Million One Hundred Four
Thousand Dollars ($2,104,000.00) and to evidence such borrowing by
the issue and sale of the general obligation coupon bonds of the County,
the proceeds thereof to be used by the County Council of Wicomico
County the several County Departments involved in capital improve-
ments needed by the health, recreation, airport, and public works pro-
grams and by the Board of Education of Wicomico County for the
construction of new school buildings, the construction of additions to
and improvements of existing school buildings, the equipping of such
school buildings and grounds and the purchase of school sites. Said
expenses to include but not being limited to, architectural and engineer-
ing fees and other expenses in conjunction with said programs; pre-
scribing the procedure for the issuance of said bonds and the terms
thereof; authorizing annual appropriations to pay the principal of and
interest on said bonds and the levying of taxes to meet said appro-
priations; providing for the formation of a Wicomico County School
Building Commission to advise said County Council and said Board
of Education regarding only the expenditure of the proceeds of the
said bonds authorized hereby to be used by the Board of Education
of Wicomico County, Maryland; and providing that the provisions of
this Act shall be separable.
Whereas, the five-year Capital Improvement Budget for Wicomico
County, Maryland adopted by the County Council of Wicomico County,
Maryland, in Executive Session, under date of January 13, 1970 provides
for a school construction and general improvement program during the
