2. The floor area of tanks in which turtles are confined must con-
tain a dry area sufficient for each turtle confined therein.
3. The shells of turtles shall not be painted or carved nor shall
decals be affixed thereto.
Section 3. Until December 7, 1970, the functions herein designated to
be performed by the County Executive shall be performed by the County
Manager.
Section 4. Severability.
The provisions of this Act are severable and if any provision, sentence,
clause, section or part thereof is held illegal, invalid or unconstitutional
or inapplicable to any person or circumstances, such illegality, invalidity
or unconstitutionality, or inapplicability shall not affect or impair any of
the remaining provisions, sentences, clauses, sections or parts of the Act
or their application to other persons or circumstances. It is hereby declared
to be the legislative intent that this Act would have been adopted if such
illegal, invalid or unconstitutional provisions, sentence, clause, section or
part had not been included therein, and if the person or circumstances
to which the Act or any part thereof is inapplicable had been specifi-
cally exempted therefrom.
Section 5. Effective date.
This Act shall take effect on the 76th day following its enactment.

An Act to amend Chapter 89, titled "Hospitals, Sanitariums, Nurs-
ing and Care Homes," of the Montgomery County Code 1965, by re-
pealing and re-enacting, with amendments, Section 89-56, titled "Au-
thority of County Manager to contract with accredited hospitals,"
and Section 89-59, titled "Non-contract hospitals," to authorize the
County Executive, with the advice of the County Health Officer, to
contract with accredited hospitals for the care of indigent County resi-
dents and to pay the cost of care for such indigents for treatment
not obtainable at a contract hospital.
Be It Enacted, by the County Council for Montgomery County, Mary-
land, that—
Section 1. Section 89-56, Chapter 89, titled "Hospitals, Sanitariums,
Nursing and Care Homes," of the Montgomery County Code 1965, is hereby
repealed and re-enacted, with amendments, to read as follows:
89-56. Authority of County Executive to contract with accredited hos-
pitals.
The County Executive with the advice of the County Health Officer,
is hereby authorized at any time and from time to time to negotiate
and contract with any hospital accredited by the American Hospital Asso-
ciation and the American College of Surgeons for the care in such hos-
pitals of indigent and medically indigent residents of the County who
