regulation to establish such fees, not to exceed the reasonable costs of
licensing and enforcement. All fees so determined shall be collected and
paid over to the Director of Finance for the use of the County.
Section 3. Section 14-2, titled "Same—Enforcement of regulations;
procedure for adoption," and 14-18, titled "Same—Procedure for adoption
of regulatory or licensing ordinance," of Chapter 14, titled "Licensing and
Regulation Generally," of the Montgomery County Code 1965, are hereby
repealed.
Section 4. Section 16-10, titled "Obstructions on public property—
Authority of Council to regulate," of Chapter 16, titled "Offenses—
Miscellaneous," of the Montgomery County Code 1965, is hereby repealed
and re-enacted, with amendments, to read as follows:
16-10. Obstructions on public property—Authority of Council to regulate.
The Council is hereby authorized to adopt and amend by law, when-
ever it shall deem the same necessary to promote the public safety and
welfare, regulations concerning the obstructing or the placing upon the
surface of public sidewalks, streets, curbs, gutters and other public rights
of way, any objects for the purpose of display, advertisement, sale, rent
or related purposes.
Section 5. Section 23-1, titled "Solicitors—Defined; licensing and re-
gulation generally," Chapter 23, titled "Solicitors, Hawkers and Peddlers,"
of the Montgomery County Code 1965, is hereby repealed and re-enacted,
with amendments, to read as follows:
23-1. Solicitors—Defined; licensing and regulation generally.
The Council is hereby authorized to provide by law for the licensing
and regulation of persons who solicit from door to door within the County
for the purpose of obtaining orders for the sale of merchandise. Such per-
sons are referred to in this Chapter as solicitors.
Such regulations may further provide for the revocation of any li-
cense issued thereunder, after an appropriate hearing, by the Director of
the Department of Inspection and Licenses upon a finding by him that
the holder of any such license has given false information or has know-
ingly withheld information in obtaining the same or has engaged in im-
proper or illegal conduct in his soliciting activities.
Section 6. Section 23-2, titled "Same—Procedure for adoption of reg-
ulations; municipalities, etc., exempted," of Chapter 23, titled "Solicitors,
Hawkers and Peddlers," of the Montgomery County Code 1965, is hereby
repealed.
Section 7. Section 75-31, titled "Application generally," the first par-
agraph of Section 75-33, titled "Applicant to file certain certificates with
Council," subsection (b), titled "Record; adjournments; rehearing," of
Section 75-34, titled "Hearing on application," Section 75-35, titled "Deci-
sion of Council on application," and Section 75-39, titled "Transfer," of
Chapter 75, titled "Amusements," of the Montgomery County Code 1965,
are hereby repealed and re-enacted, with amendments, to read as follows:
75-31. Application generally.
All applications for a license required by this Division shall be made
to the Department of Inspection and Licenses on such form as shall be
designated. Applications shall not be accepted for filing unless accom-
