(2) License or contract with a contractor to collect and dispose of
such refuse under such regulations as to charges and methods as it deems
advisable;
(3) Contract for the construction or operation or both of incinera-
tors to or other disposal plants, to be paid for from charges or otherwise,
and to become the property of the County after such period and upon such
terms as it may prescribe.
(b) While the County or any other board or agency is providing
refuse collection service in any area of the County, all authority of any
other board or agency shall be suspended as to that area.
Section 3. Section 11-16, Chapter 11, title "Health and Sanitation,"
of the Montgomery County Code 1965, is hereby repealed in its entirety.
Section 4. Severability.
The provisions of this Act are severable and if any provision, sentence,
clause, section or part thereof is held illegal, invalid or unconstitutional
or inapplicable to any person or circumstances, such illegality, invalidity
or unconstitutionally, or inapplicability shall not affect or impair any of
the remaining provisions, sentences, clauses, sections or parts of the Act
or their application to other persons or circumstances. It is hereby declared
to be the legislative intent that this Act would have been adopted if
such illegal, invalid or unconstitutional provision, sentence, clause, section
or part had not been included therein, and if the person or circumstances
to which the Act or any part thereof is inapplicable had been specifically
exempted therefrom.
Section 5. Effective date.
This Act shall take effect on December 7, 1970.

An Act to amend Chapter 84, Article II thereof, titled "Contracts,
Purchases and Sales," of the Montgomery County Code 1965, by repeal-
ing and re-enacting, with amendments, Sections 84-11 through 84-23,
and to add a new Section 84-12A, title "Non-discrimination in Employ-
ment," so as to provide that the competitive bid requirement is raised
to $3,000, to provide that enforcement shall be supervised by the chief
administrative officer, to provide for the function and structure there-
of, and to provide for a policy of non-discrimination in employment
by contractors.
Be It Enacted by the County Council for Montgomery County, Maryland,
that—
Section 1. Sections 84-11 through 84-23, Chapter 84, Article II, title
"Contracts, Purchases and Sales," of the Montgomery County Code 1965
are hereby repealed and re-enacted, with amendments, and a new Section
84-12A, title "Non-discrimination in Employment," is hereby added to read
as follows:
84-11. Definitions.
For the purposes of this article, the following terms, phrases, words
and their derivations shall have the following meanings:
