Chapter 44
(Bill No. 48-69)

An Act to amend Chapter 44, title "Silver Spring, Bethesda, Wheaton
and Montgomery Hills Parking Lot Districts," of the Montgomery
County Code 1965, by repealing and re-enacting, with amendments,
Section 44-12, title "Same—Lease to Montgomery County Revenue
Authority," Section 44-13, title "Administration and enforcement—
Generally," and Section 44-16, title "Parking meters generally"; Chap-
ter 73, title "Administration," of the Montgomery County Code 1965,
by repealing and re-enacting, with amendments, Section 73-31, title
"Storage, parking and use generally"; Chapter 86, title "Fire Preven-
tion Code," of the Montgomery County Code 1965, by repealing and
re-enacting, with amendments, subsection (a) of Section 86-16, title
"Removal, etc., of dangerous conditions"; Chapter 106, title "Taxi-
cabs," of the Montgomery County Code 1965, as amended, by repealing
and re-enacting with amendments, Section 106-25, title "Stands and
call boxes generally"; Chapter 108, title "Vehicles, Traffic and Park-
ing," of the Montgomery County Code 1965, by repealing and re-
enacting, with amendments, subsections (a) and (b) of Section 108-1,
title "Authority of school crossing guards; penalty for failure to obey
school crossing guards," Section 108-2, title "Snow and ice emergency
traffic control," Section 108-3, title "Parking of vehicles during periods
of snow accumulation," Section 108-5, title "Authority of County
Manager to regulate by signs," Section 108-7, title "Duty of police
as to illegally parked vehicles; notice to owner; penalty," and Section
108-16, title "Duty of police—To report illegally parked vehicles;
information to be shown"; Chapter 115, title "Parking Regulations,"
of the Montgomery County Code 1965, by repealing and re-enacting,
with amendments, Section 115-10, title "Applicability of Article," to
authorize the leasing of parking lots to the County Revenue Authority;
to authorize the County Executive to approve the location of parking
meters, and adopt regulations regarding parking meters; to provide
that parking meter regulations be administered and enforced by the
Department of Public Works; to authorize the county executive to
regulate the use of County vehicles; to authorize the county executive
or his designee to regulate parking to effectuate the fire code; to
authorize the county executive or his designee to provide for taxicab
stands and call boxes; to provide for the appointment and duties of
school crossing guards; to authorize the county executive to declare
a snow emergency, designate snow emergency routes and regulate the
parking of vehicles during snow emergencies; to authorize the county
executive to regulate parking within the County and fix, with the
approval of the Council, penalties for parking violations, and to au-
thorize the county executive or his designee to designate persons to
police parking meters; to authorize the county executive to enforce
County parking regulations in incorporated towns and special taxing
areas; and to eliminate an obsolete reference to the 1948 Charter.

Be It Enacted by the County Council for Montgomery County, Mary-
land,
that—

Section 1. Section 44-12, Chapter 44, title "Silver Spring, Bethesda,
Wheaton and Montgomery Hills Parking Lot Districts," of the Montgomery
County Code 1965, is hereby repealed and re-enacted, with amendments,
to read as follows:
