shall designate one member of the range approval committee to serve as
chairman. One ex officio member shall be an employee of the division of
police protection. The committee shall issue target, trap and skeet range
and shooting area approval certificates which certificates may specify the
type of gun or ammunition which may be used on such range or area. Any
such approval certificate shall be valid for eighteen months after its issu-
ance, and shall be issued only upon a finding by a majority of the com-
mittee that the discharge of guns upon such ranges or area will not
jeopardize life or property. No range or area shooting certificate shall be
issued except upon the written application of the owner, lessee or person
lawfully in possession of the land upon which is located the range or area
sought to be licensed or approved. All certificates shall be retained by the
range approval committee as part of its permanent records.
Section 21. Section 113-2, Chapter 113, title "Elm Disease," of the
Montgomery County Code 1965, is hereby repealed and re-enacted, with
amendments, to read as follows:
113-2. Administration and enforcement of chapter.
The county forester is hereby charged with the responsibility for
administration and enforcement of this chapter.
Section 22. Severability.
The provisions of this Article are severable, and if any provision,
sentence, clause, section or part thereof is held illegal, invalid or uncon-
stitutional or inapplicable to any person or circumstances, such illegality,
invalidity or unconstitutionally, or inapplicability shall not affect or im-
pair any of the remaining provisions, sentences, clauses, sections or parts
of the Article or their application to other persons or circumstances. It is
hereby declared to be the legislative intent that this Article would have
been adopted if such illegal, invalid or unconstitutional provision, sentence,
clause, section or part had not been included therein, and if the person or
circumstances to which the Article or any part thereof is inapplicable had
been specifically exempted therefrom.
Section 23. Effective date.
This Act shall take effect on December 7,1970.

An Act to amend Chapter 2, title "Administration," of the Mont-
gomery County Code 1965, by repealing and re-enacting, with amend-
ments, the title of Article II, title "Powers of Council Generally,"
subsection (a) of Section 2-17, title "Corporate powers generally,"
Section 2-69, title "Acquisition of land," Section 2-135, title "Pur-
chase or lease of land—By county generally," Section 2-137, title
"Same-By public library, rescue squad or fire department," Section
2-139, title "Public hearing not required when land is donated;
decisions," to authorize the County to acquire land for school sites
and to purchase the physical equipment necessary or incident thereto;
to authorize the County to acquire land for county use; to provide for
the process by which land shall be selected for acquisition; and to
provide for notice and public hearings.
