Section 1. Section 2-72, title "Recreation Board—Creation authorized
by resolution," of Chapter 2, title "Administration," of the Montgomery
County Code 1965 is hereby repealed in its entirety.
Section 2. The Montgomery County Recreation Board created by
Resolution No. 6-1507 shall continue in existence as constituted prior to
this enactment. It shall consist of the same number of members, appointed
in the same manner for the same term with the same duties and respon-
sibilities as fully set forth in Resolution No. 6-1507; provided, however,
that subsequent to the effective date of this Act the board shall cease to be
advisory to the County Manager and shall instead be advisory to the
County Council on legislative and policy matters relating to recreation and
to the County Executive for whom the board shall interpret recreation
policies and programs. Subsequent to the effective date of this Act, vacan-
cies on the Recreation Board shall be filled by the County Executive with
the approval of the Council.
Section 3. This Act shall take effect on December 7, 1970.

An Act to amend Chapter 2, title "Administration," and Chapter 9,
title "Elections," of the Montgomery County Code 1965, by repealing
and re-enacting, with amendments, Section 2-3, title "Same—Filing
of petition; publication of amendment," Section 9-14, title "Petition—
Form," Section 9-15, title "Same—Signatures, etc.," Section 9-16, title
"Same—Filing," Section 9-17, title "Same—Notification of council;
public notice; holding," and Section 9-19, title "Return of election re-
turns to council; public notice to be given"; to designate the filing of
Referendum Petitions for Charter Amendments with the County
Executive; to delete certain obsolete references to the Charter adopted
by the voters at the general election of November 2, 1948; to eliminate
specific references to the number of signatures required on a referen-
dum petition and time requirements for filing a referendum petition
and inserting in lieu thereof that such number of signatures and time
requirements shall be established by the Charter; to provide for notice
to the County Executive of the filing of referenda on laws enacted by
the Council; and to designate that public notice of election returns be
given by the County Executive.
Be It Enacted by the County Council for Montgomery County,
Maryland, that—

amendment," Chapter 2, title "Administration," is hereby repealed and
re-enacted, with amendments, to read as follows:
2-3. Same—Filing of petition; publication of amendment.
All sheets of a referendum petition shall be filed with the county
executive on or before the date prescribed by public general law of the
state or the Charter of the County, whichever shall be applicable. If such
date is not prescribed by public general law or Charter, then such filing
shall occur not later than sixty days preceding the date of the next regular,
general or congressional election at which such proposed amendment is to
