2290                                County Local Laws

The director shall require the applicant to show that the applicant is
qualified to perform such work in a capable manner so as not to endanger
the life and property of himself, persons in the neighborhood or property
belonging to public utility suppliers. If the director finds the applicant
qualified to perform such work, a permit will be issued subject to compli-
ance with all requirements of this chapter. No permit shall be required
for minor repairs, etc. as defined in Sec. 83-9(d) of this chapter.

This Article shall not apply to electrical installations or work on
equipment installed by, and for the use of any public utility company
regulated by the Public Service Commission of Maryland, and accessory
wiring and equipment necessary to operate the generation, transmission
and distribution systems.

Sec. 83-31. Article Does Not Exempt Compliance with Electrical Codes.

Nothing in this Article shall be construed to exempt any electrical
work in the county from complying with the requirements of the National
Electrical Code and the Montgomery County Electrical Code.

Sec. 83-32. Violations, Penalties and Enforcement.

Any person, firm, company, corporation or partnership in violation
of the provisions of this Article shall be guilty of a misdemeanor and,
upon conviction thereof, shall be subject to a fine of not more than five
hundred dollars ($500.00) or imprisonment for not more than six (6)
months, or both.

DIVISION II. ELECTRICAL BOARD GENERALLY
Sec. 83-33. Created; Composition.

There is hereby created a board of electrical examiners composed of
five (5) voting members, residents of the county, constituted as follows:

(a)    One member shall be an electrical contractor.

(b)    Three members shall be active at the time of their appointment,
or shall have had previous experience, as an electrical contractor, electrical
contractor limited, as an electrical engineer, or shall otherwise be techni-
cally qualified to determine proficiency in the electrical field.

(c)    One member shall represent the general public.

(d)    A member of the office of the Montgomery County fire marshal
and a member of the office of the department of inspection and licenses
shall be assigned as ex officio non-voting members of the board.

(e)    The chairman of the board shall be designated by the council.
If the council does not designate a chairman, the board shall elect its
own chairman. The board shall select a vice-chairman and such other
officers as it may desire. The vice-chairman shall, in the absence of the
chairman, assume all the duties and responsibilities of the chairman.

Sec. 83-34. Appointment and Terms of Members.

Original members of the board shall be appointed by the county
council for terms expiring one, two and three years, respectively, as
designated by the county council at the time of appointment. All appoint-
ments to the board thereafter shall be for a term of three (3) years, except,
that any member appointed to fill a vacancy occurring prior to the expira-
tion of a term shall be appointed for the remainder of that term.
