Section 1. Be it enacted by the County Council of Howard County,
Maryland, That Sections 12.215 through 12.219 be and they are hereby
added to Title 12 of the Howard County Code "Health," subtitle "Board of
Health," to read as follows:
12.215—Sanitary Facilities
On or before July 30, DECEMBER 31, 1970, all businesses serving
food to the public to be consumed on the premises where sold, in Howard
County, Maryland, and with a seating capacity of ten (10) WITH A MIN-
IMUM OF FIFTEEN (15) persons, shall provide for the use of customers
separate sanitary washing and toilet facilities for men and women. The
facilities so provided shall be sufficient to meet the standards prescribed
by the County Health Officer.
12.216—Applicability
This Act shall include within its provisions, but not be limited to, all
public eating facilities which are located in, or are part of any dry goods
store, drug store, or other merchandising establishment.
12.217—Enforcement
Any public eating facility coming within the provisions of this Act
which shall fail to meet the herein prescribed standards on or before
July 30, DECEMBER 31, 1970, shall, MAY, after hearing thereon, be
ordered closed by the County Board of Health for public use until the
facilities required by this Act are provided.
12.218—Penalties
Any person owning or operating a place of business in Howard County,
Maryland, coming within the provisions of this Act, who, having received
an order from the Board of Health ordering that the establishment shall
be closed pursuant to the provisions of this Act, who shall refuse to obey
said order shall be guilty of a misdemeanor and upon conviction thereof
shall be fined not less than $10.00 nor more than $200.00, each day the
business remains open in contravention to the order of the Board of Health.
Each day upon which the said business remains open in contravention of
the order of the Board of Health shall constitute a separate offense under
this Act.
12.219—EXEMPTIONS
NOTWITHSTANDING ANY OTHER PROVISION OF THIS ACT,
THE COUNTY HEALTH OFFICER MAY IN HIS DISCRETION GRANT
AN EXEMPTION FROM THE PROVISIONS OF THIS ACT TO ANY
BUSINESS OPEN AND SERVING FOOD AS OF THE EFFECTIVE
DATE OF THIS ACT.
Section 2. Be it further enacted by the County Council of Howard
County, Maryland, That this Act shall take effect sixty (60) days after
its enactment.
