Public Local Laws of Maryland) to repeal and re-enact, with amend-
ments, Section 48-4(e) thereof to remove the words "general in nature
and permanent in effect" following the word "ordinance" in the first
sentence so as to provide that no ordinance shall be passed at the
meeting at which it is introduced; to provide for a requirement of a
public hearing prior to action on a proposed ordinance if two or more
members of the Council so request; to provide, when required, proce-
dures by which public notice shall be given of such public hearing; to
authorize the Mayor and Council to establish procedures for the con-
duct of such public hearings; to establish a procedure by which the
provision that an ordinance may not be passed at a meeting at which
it was introduced may be suspended; and to provide that all ordi-
nances, passed by the Council shall become effective immediately unless
otherwise specified.

Section 1. BE IT RESOLVED by The Mayor and Council of Rockville
that the Charter of said municipal corporation as set forth in Sections
48-1 to 48-95, inclusive, of the Code of Public Local Laws of Montgomery
County (1965 Edition, as amended, being Article 16 of the Code of Public
Local Laws of Maryland), be and the same is hereby repealed and re-
enacted, with amendments, under Section 48-4(e) to read as follows:

"Section 48-4.

(e) No ordinance [general in nature and permanent in effect] shall
be passed at the meeting at which it is introduced. If, at the meeting at
which an ordinance is introduced, two or more members of the council so
request, a public hearing shall be required as herein provided prior to
action thereon. Public hearings on ordinances shall be held by the Mayor
and Council,, when required, only after first having given public notice in a
newspaper of general circulation in the City of Rockville once a week for
two successive weeks, the last such notice to appear at least ten (10) days
prior to the public hearing. Such public notice shall generally summarize
the contents of the proposed ordinance, and shall specify the time and place
of the public hearing to be held thereon. Such public hearing shall be con-
ducted by the Mayor and Council, when required, under such procedures as
it shall, in its discretion, establish.
After the ordinance is introduced, it
shall lay over for at least one week, after which it may be brought up for
discussion, amendment or final action [; provided, however, that its title
shall have been included on the published agenda for the meetings at
which final action takes place and provided further that all other require-
ments of law for published notice or hearing shall have been complied
with. Such] ,, except in the case of an ordinance for which a public hearing
is required, in which case it may not be brought up until after the re-
quired public hearing. The published agenda for the meeting at which
final action takes place on any ordinance shall contain the descriptive title
of the ordinance, and such
descriptive titles shall be published and perma-
nently filed by the city clerk and shall be kept available for public inspec-
tion. The provision that an ordinance may not be passed at the meeting at
which it was introduced and the provision for inclusion of the descriptive
title of the ordinance on the published agenda for the meeting of the
Mayor and Council may be suspended by the affirmative vote of four mem-
bers of the council. All ordinances passed by the council shall become
effective immediately unless otherwise specified."

Section 2. BE IT FURTHER RESOLVED that the date of the adop-
tion of this Resolution is October 5, 1970, and that the amendment to the
Charter of The Mayor and Council of Rockville hereby proposed by this
