ARTICLE IX. PERSONNEL ADMINISTRATION
Section 137-A. Retirement.
All employees appointed under the provisions of this Article shall hold
their respective positions, unless discharged, retired, or otherwise incapa-
ble of serving, until they become sixty-five years old, when they shall be
retired.
Section 2. BE IT FURTHER RESOLVED, that the date of the
passage of this Resolution is November 20, 1969, and the amendment of the
Charter of the City of Frederick, hereby enacted, shall become effective
on January 9, 1970, unless a proper petition for a referendum herein shall
be filed as provided by Section 13 of Article 23A of the Annotated Code of
Maryland, and provided a complete and exact copy of this Resolution shall
be continuously posted at City Hall, Frederick, Maryland, until December
30, 1969 and provided further that a fair summary of the proposed amend-
ment shall be published in the News & Post, a newspaper of general
circulation in the City of Frederick, once in each of the weeks of November
25, December 2, 9 and 16, 1969.
Section 3. BE IT FURTHER RESOLVED AND ORDAINED that
the Mayor of Frederick shall send separately by registered mail to the
Secretary of the State of Maryland and the Department of Legislative
Reference the complete text hereof; the date of referendum election, if
any; the number of votes cast for and against the question containing the
charter amendment, whether in the legislative body or in a referendum
and effective date of the charter amendment.

Resolution No. 2-70
A RESOLUTION to propose an amendment to the Charter of the
City of Frederick by repealing Section 176 of Article XV, entitled
"Planning and Zoning," and enacting a new section 176, in lieu
thereof to stand in the place instead of the section so repealed.
Section 1. BE IT RESOLVED, ENACTED AND ORDAINED by
the Mayor and Board of Aldermen of the City of Frederick, that the
Charter of the City of Frederick, as the same was enacted by the General
Assembly of Maryland in Chapter 539 of the laws of 1951, be and the same
is hereby amended by repealing Section 176 of Article XV, entitled
"Planning and Zoning," and enacting new Section 176 in lieu thereof to
stand in the place instead of the section so repealed, the same to read as
follows:
ARTICLE XV. PLANNING AND ZONING.
Section 176. Planning and Zoning Commission—Composition; Ap-
pointment; Term; Removal; Compensation.
There shall be a Planning and Zoning Commission which shall consist
of 5 members, namely, a member of the Board of Aldermen, and 4 per-
