Charter Amendment
Resolution No. 48

A RESOLUTION of the Mayor and City Council of Cumberland,
Maryland, adopted pursuant to the authority contained in Article 11-E
of the Constitution of the State of Maryland, and Section 13 of Article
23A of the Annotated Code of Maryland, entitled "Municipal Corpora-
tions," as said Section was enacted by Chapter 423 of the Acts of the
General Assembly of Maryland, 1955, entitled "A RESOLUTION TO
AMEND THE CHARTER OF THE CITY OF CUMBERLAND,
MARYLAND, (1966 EDITION), BY REPEALING AND RE-
ENACTING, WITH AMENDMENTS, SECTIONS 12 AND 13 OF
SAID CHARTER, FOUND UNDER THE SUBTITLE 'MAYOR AND
COUNCIL', PERTAINING TO QUALIFICATIONS, OATH AND
TERMS OF OFFICE AND COMPENSATION OF THE MAYOR
AND COUNCILMEN."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That Section 12 of the Charter of the City of
Cumberland (1966 Edition), be and is hereby repealed and re-enacted to
read as follows:

"The Mayor shall not be less than thirty years of age, and each of the
said four councilmen shall not be less than twenty-five years of age at the
time of their election; they shall each of them be citizens of the United
States and for five years immediately preceding their election residents of
the City of Cumberland. The Mayor and Councilmen shall, upon taking
the prescribed oath of office before the Clerk of the Circuit Court for
Allegany County,
hold office for a period of four years from the first
Monday in July next succeeding their election and until their successors
have been duly elected and qualified. The Mayor shall serve as President
of the City Council."

Section 2. AND BE IT FURTHER RESOLVED, That Section 13 of
the Charter of the City of Cumberland (1966 Edition), be and is hereby
repealed and reenacted to read as follows:

"(a) Each Councilman shall receive as compensation for his services
in the performance of his duties for the fiscal year 1970-71, the sum of
$2200.00; for the fiscal year 1971-72, the sum of $2600.00; and for the
fiscal year 1972-73 and each year thereafter, the sum of $3,000.00.

"(b) The Mayor shall receive as compensation for his services in the
performance of his duties for the fiscal year 1970-71, the sum of $4400.00
for the fiscal year 1971-72, the sum of $5200.00; for the fiscal year 1972-73,
and each year thereafter, the sum of $6,000.00.

"(c) The compensation herein provided shall be in lieu of all other
forms of compensation to be received from the City of Cumberland, and
shall be paid in accordance with established payroll procedures."

Section 3. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is July 6, 1970, and the amendments to the
Charter of the City of Cumberland hereby enacted, shall become effective
on August 25, 1970, unless a proper Petition for a Referendum hereon
shall be filed as prescribed by Section 13 of Article 23A of the Annotated
Code of Maryland, and provided a complete and exact copy of this Resolu-
tion shall be continuously posted on the North Centre Street entrance of
the City Hall, Cumberland, Maryland, until August 15, 1970 and pro-
