copy of the text of this Resolution, the date of the referendum, if any is
held, and a certificate showing the number of Councilmen voting for and
against it, and a report on the votes cast for or against the amendments
hereby enacted at any referendum thereon, and the effective date of the
Charter Amendment.

This Resolution passed this 3rd day of March, 1970.

The Charter Amendment enacted by the aforegoing Resolution became
effective this 22nd day of April, 1970.

I HEREBY CERTIFY, That the aforegoing Resolution amending the
Charter of the City of Cumberland, Maryland, was passed this 3rd day of
March, 1970, with 3 votes in the affirmative and 1 vote in the negative.

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of Charter Amendment Resolution No. 45, passed by the Mayor and City
Council of Cumberland, Maryland, in Regular Session on March 3, 1970.

I FURTHER CERTIFY, That there was no Petition for a Referendum
on the proposed amendments filed within the required time and, therefore,
the same became effective on April 22, 1970.

Charter Amendment
Resolution No. 46

RESOLUTION of the Mayor and City Council of Cumberland,
Maryland, adopted pursuant to the authority contained in Article
11-E of the Constitution of the State of Maryland, and Section 13
of Article 23A of the Annotated Code of Maryland, entitled
"Municipal Corporations," as said Section was enacted by Chapter
423 of the Acts of the General Assembly of Maryland, 1955, entitled
"A RESOLUTION TO RESCIND CHARTER AMENDMENT RESO-
LUTION NO. 30 AND CHARTER AMENDMENT RESOLUTION
NO. 31, SAID CHARTER AMENDMENT RESOLUTIONS HAVING
BEEN FORMERLY ADOPTED BY THE MAYOR AND CITY
COUNCIL OF CUMBERLAND."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, That Charter Amendment Resolutions Nos. 30
and 31, adopted respectively on February 12, 1968, and February 19, 1968,
to provide the Mayor and City Council of Cumberland, under Section
81(b) of the City Charter, with the authority to levy and collect a tax on
the assessable property of said City for the general purposes of said
corporation, not exceeding in any one year One Dollar and Fifty Cents
($1.50) on each One Hundred Dollars ($100) worth of said assessable
property, be and they are hereby rescinded.
