Senate Bill No. 810—Lieutenant Governor's Duties

AN ACT to repeal and re-enact, with amendments, Sections 360
(b) and 360 (c) of Article 41 of the Annotated Code of Maryland
(1965 Replacement Volume and 1970 Supplement), title "Governor—
Executive and Administrative Departments," subtitle "31 Capital
City Commission," adding the Lieutenant Governor to the membership
of the Capital City Commission, and adding one new Gubernatorial
appointee to the Capital City Commission, and generally relating
thereto.

Dear Mr. President:

In accordance with Article II, Section 17, of the Maryland Con-
stitution, I have today vetoed Senate Bill 810.

This bill makes the Lieutenant Governor a member of the Capital
City Commission.

In my opinion, Senate Bill 810 conflicts with Article II, Section
1A, of the Maryland Constitution, which provides that the Lieutenant
Governor "shall have only the duties delegated to him by the Gov-
ernor***." (Emphasis supplied). The legislation would in effect dele-
gate duties to the Lieutenant Governor, i.e., requiring him to serve as
a member on the Capital City Commission and to perform all of the
other duties that a member of that Commission must perform under
the law. The purpose of the above-quoted language in the recently
adopted constitutional amendment establishing the office of Lieutenant
Governor, was to insure that duties would not be assigned to the
Lieutenant Governor by statute. For this reason, I believe that Senate
Bill 810 must be vetoed.

However, I am fully in accord with the intent of Senate Bill 810,
that the Lieutenant Governor be a member of the Capital City Com-
mission. At present there are vacancies among the appointed member-
ship of the Commission. Consequently, I am today appointing the
Lieutenant Governor to the Capital City Commission.
