the defendant, shall be divided amongst the above-mentioned parties,
in such shares as the jury by their verdict shall find a AND direct;
provided, that no more than one action shall lie for and in respect of
the same subject matter of complaint; and that every such action
shall be commenced within [two] three years after the death of
the deceased person.

Sec. 2. And be it further enacted, That the provisions of this Act
shall be applied prospectively and retrospectively to have effect upon
or application to any cause of action arising prior to July 1, 1968.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1971.

(House Bill 911)

AN ACT to repeal and re-enact, with amendments, Section 33 of
Article 101 of the Annotated Code of Maryland (1964 Replace-
ment Volume), title
"Workmen's Compensation," subtitle "Appli-
cation of Article; Extra Hazardous Employments," as
added by
Chapter .... (House Bill 105) of the 1971 Laws of Maryland, (1970
SUPPLEMENT AS AMENDED BY CHAPTER 741 OF THE
ACTS OF 1970 AND CHAPTER .... (HOUSE BILL 105) OF THE
ACTS OF 1971), TITLE "WORKMEN'S COMPENSATION,"
SUBTITLE "APPLICATION OF ARTICLE; EXTRA-
HAZARDOUS EMPLOYMENTS to provide that whenever bene-
fits are furnished by an employer, as defined, equal to or better
than the benefits provided under Article 101 of the Annotated
Code of Maryland, such defined employer shall be released of any
obligation thereunder, but should such benefits be less than those
required by the said Article 101, such defined employer shall make
up the difference, and the Workmen's Compensation Commission
is empowered to determine whether such benefits are equal to or
better than the benefits required under said Article 101; to author-
ize the Workmen's Compensation Commission to make an award
for any benefit furnished by an employer which is less than required
by this Article; and to provide that the Workmen's Compensation
Commission shall have continuing jurisdiction over cases arising
under this Section.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 33 of Article 101 of the Annotated Code of Maryland
(1964 Replacement Volume), title "Workmen's Compensation," sub-
title Application of Article; Extra Hazardous Employments," as

added by Chapter...(House Bill 105) of the 1971 Laws of Mary-

land, (1970 SUPPLEMENT AS AMENDED BY CHAPTER 741
OF THE ACTS OF 1970 AND CHAPTER .... (HOUSE BILL 105)
OF THE ACTS OF 1971), TITLE "WORKMEN'S COMPENSA-
TION," SUBTITLE "APPLICATION OF ARTICLE; EXTRA-
HAZARDOUS EMPLOYMENTS be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
