(a) The counties and municipalities shall have the power and
authority to issue grading and building permits as otherwise provided
by law. No grading or building permit shall be issued until the
developer submits a grading and sediment control plan [designed by
a professional engineer registered in the State of Maryland;] ap-
proved by the appropriate soil conservation district, and the developer
certifies that all land clearing, construction and development will
be done pursuant to the said plan. Except for those matters exempted
under Section 107 above, a grading and sediment control plan must
be submitted to and approved by the appropriate soil conservation
district, even in such matters where the county or municipality re-
lieves the developer from the necessity of obtaining a grading or
building permit. Criteria for sediment control and for referral of
an applicant to the appropriate soil conservation district shall be
acceptable to the soil conservation district and the Department of
Natural Resources. The county agency responsible for on site in-
spection and enforcement of the provisions of this [subheading]
subtitle shall make a final inspection and forward its report to the
appropriate conservation district. Notice of violation of the pro-
visions of this subtitle shall be filed with the Department of Natural
Resources, as well as with the appropriate county agency.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
SEC. 2. AND BE IT FURTHER ENACTED, THAT THIS ACT
IS HEREBY DECLARED TO BE AN EMERGENCY MEASURE
AND NECESSARY FOR THE IMMEDIATE PRESERVATION
OF THE PUBLIC HEALTH AND SAFETY AND HAVING BEEN
PASSED BY A YEA AND NAY VOTE SUPPORTED BY THREE-
FIFTHS OF ALL THE MEMBERS ELECTED TO EACH OF THE
TWO HOUSES OF THE GENERAL ASSEMBLY, THE SAME
SHALL TAKE EFFECT FROM THE DATE OF ITS PASSAGE.

AN ACT to add new Section 98B to Article 77 of the Annotated Code
of Maryland (1969 Replacement Volume and 1970 Supplement),
title "Public Education," subtitle "Chapter 6. The Public Schools,"
to follow immediately after Section 98A thereof, to authorize the
use of corporal punishment by teachers and principals in certain
counties of the State.
Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 98B be and it is hereby added to Article 77 of the
Annotated Code of Maryland (1969 Replacement Volume and 1970
Supplement), title "Public Education," subtitle "Chapter 6. The
Public Schools," to follow immediately after Section 98A thereof,
and to read as follows:
