CHAPTER 754
(Senate Bill 69)

AN ACT to add new Section 84A to Article 23 of the Annotated
Code of Maryland (1966 Replacement Volume, and 1970 Cumula-
tive Supplement), title "Corporations," subtitle "Forfeiture and
Revival," to follow immediately after Section 84 thereof, to pro-
vide for the forfeiture of a corporate charter or the revocation
of the permit authorizing any foreign corporation to carry on
business in this State when a corporate officer or other person con-
trolling the corporation, with the actual or constructive knowledge
of the president and a majority of the directors, is a person
engaged in organized crime or who is connected with organiza-
tions or criminal societies engaging in organized crime, or a
director, officer, employee, agent or stockholder acting for, through
or on behalf of a corporation in conducting the corporation's
affairs, purposely engages in a persistent course of organized
crime or other criminal conduct, with the actual or constructive
knowledge of the president and a majority of the directors, with
the intent to get other persons or businesses to deal with the
corporation or engage in organized crime; and for the prevention
of future illegal conduct of the same character; and to permit the
Attorney General to seek to enjoin the operation of any non-
corporate business when any person in theory or in fact exercises
control over the business, or employee or agent of that business
purposely engages in a persistent course of organized crime or
other illegal conduct with the intent to compel or induce other
persons or businesses to deal with that business or engage in organ-
ized crime; and for the prevention of future illegal conduct of the
same character; and for the purpose of making available any other
proceeding authorized by law for the purpose of forfeiting the
charter of a corporation or revoking the permit of a foreign
corporation.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 84A be and it is hereby added to Article 23 of the
Annotated Code of Maryland (1966 Replacement Volume, and 1970
Cumulative Supplement), title "Corporations," subtitle "Forfeiture
and Revival," to follow immediately after Section 84 thereof, and to
read as follows:

84A.

(a) The term "organized crime" means any combination or con-
spiracy to engage in criminal activity as a significant source of
income or livelihood, or to violate, aid or abet the violation of crim-
inal laws relating to prostitution, gambling, loan sharking, drug
abuse, illegal drug distribution, counterfeiting, extortion, corruption
of law enforcement officers or other public officers or employers.
