CHAPTER 714
(House Bill 752)

AN ACT to repeal and re-enact, with amendments, Section 387C
(b)1(II) and (b)4(vii) of Article 43 of the Annotated Code of
Maryland (1970 Cumulative Supplement), title "Health," subtitle
"Water, Ice and Sewerage," and to add a new Section 387C(b)l
(III) to said Article and title of the Code to follow immediately
after Section 387C(b)1(II) thereof, to provide that in Montgomery
County, the County Council shall have the responsibility and au-
thority for the approval of its county plans and annual revisions
dealing with water supply systems, sewerage systems and solid
waste disposal and acceptance systems, to provide that the County
Executive shall have the responsibility for preparing the plans and
annual revisions, to authorize the County Council and the County
Executive to obtain coordination of the county plans with the
Washington Suburban Sanitary Commission and the Maryland-
National Capital Park and Planning Commission, and relating
generally thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 387C(b)1(II) and (b)4(vii) of Article 43 of the Anno-
tated Code of Maryland (1970 Cumulative Supplement), title
"Health," subtitle "Water, Ice and Sewerage," be repealed and re-
enacted, with amendments, and a new Section 387C(b)1(III) be
added to said Article and title of the Code to follow immediately after
Section 387C (b) 1 (II) thereof and to read as follows:

387C(b)l.

(II) In Prince George's [and Montgomery counties] county the
governing [bodies] body shall [respectively] establish the goals,
purposes and concepts that [each] it desires to serve as a basis for
the plans for its county which are required by this section and trans-
mit the same not later than May 1, 1968, and with annual revisions
on the first day of July, 1970 and on the first day of July in each year
thereafter, to the Washington Suburban Sanitary Commission,
directing the said Commission to immediately prepare and coordi-
nate with the governing [bodies] body the water and sewerage
county plans and all revisions and amendments thereto, which are
required by or provided for in this section and all of such revisions,
plans and amendments shall be submitted by the said Washington
Suburban Sanitary Commission to the [respective] governing
[bodies] body not later than October 15, 1969 and annually there-
after no later than October 1st, for [their] its consideration and
action. The governing body of [each of the two mentioned counties]
Prince George's County shall hold a public hearing on the county
plan, and the annual review thereof, ten days notice of which shall
be given by one publication in a newspaper or newspapers of general
