(House Bill 397)

AN ACT to add new Section 21(49c) to PARAGRAPH (7) TO
SUBSECTION (B) OF SECTION 21 OF Article 101 of the Anno-
tated Code of Maryland (1970 Supplement), title "Workmen's
Compensation," subtitle "Application of Article; Extra-Hazardous
Employments," to follow immediately after Section 21 (49b)
PARAGRAPH (6) OF SUBSECTION (B) OF SECTION 21
thereof, to extend coverage of the Workmen's Compensation Law
to farming and dairy farming, other than office work WITH
CERTAIN EXCEPTIONS AND TO REPEAL SECTION 21
(C)(5) OF SAID ARTICLE 101 AND SAID SUBTITLE AS
AMENDED BY CHAPTER 741 OF THE ACTS OF 1970 RE-
PEALING A PROVISION EXEMPTING FROM THE COV-
ERAGE OF SAID CHAPTER 741 ANY PERSON EM-
PLOYED IN AGRICULTURE.

Section 1. Be it enacted by the General Assembly of Maryland,

That new Section 21(49c) be and it is hereby added to PARA-

GRAPH (7) TO SUBSECTION (B) OF SECTION 21 OF Article 101
of the Annotated Code of Maryland (1970 Supplement), title "Work-
men's Compensation," subtitle "Application of Article; Extra-
Hazardous Employments," to follow immediately after Section
21(49b)
PARAGRAPH (6) OF SUBSECTION (B) OF SECTION
21 thereof and to read as follows:

21(49c) 21(B)(7).

Farming and dairy farming, other than office work, and including,
by way of illustration and not by way of limitation, the operation of
any machinery connected with any phase of soil, crop or animal
management, construction and repairs of machinery and fixtures,
and the handling of any crops or animals with or without machinery.

FOR THE PURPOSES OF THIS SECTION, A FARMER IS
DEFINED AS ONE WHO HAS THREE (3) OR MORE FULL-
TIME EMPLOYEES OR WHO HAS A YEARLY PAYROLL FOR
HIS FULL-TIME EMPLOYEES OF AT LEAST FIFTEEN THOU-
SAND DOLLARS ($15,000) PROVIDED, HOWEVER, THAT
THIS SECTION SHALL NOT APPLY TO SEASONAL OR
MIGRATORY FARM LABORERS WHO DO NOT OPERATE
MACHINERY OR EQUIPMENT.

SEC. 1A. AND BE IT FURTHER ENACTED, THAT SEC-
TION 21(C)(5) OF SAID ARTICLE 101 AND SAID SUB-
TITLE AS AMENDED BY CHAPTER 741 OF THE ACTS
OF 1970 BE AND THE SAME IS HEREBY REPEALED.
