persons displaced as a result of land acquisition by the State and its
political subdivisions or agencies or public or private organizations
acquiring land for public purposes. It is the legislative intention
that persons who are displaced as a result of land acquisition in such
cases shall not suffer disproportionate injuries as a result of pro-
grams designated for the benefit of the public as a whole.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 6A and 6B of Article 33A of the Annotated Code of
Maryland (1965 Edition and 1971 Replacement Volume), title "Emi-
nent Domain" be and they are hereby repealed, and that new Sections
6A through 6-I 6H be and they are hereby enacted in lieu thereof, to
stand in the place of the sections so repealed, and to be under the new
subtitle "Relocation Assistance Policies and Payments," said new
sections to follow immediately after Section 6 thereof and to read
as follows:
RELOCATION ASSISTANCE POLICIES AND PAYMENTS
6A. Definitions.
(a) The term "condemning authority" shall mean the State, a
political subdivision or any agency thereof, or any board or com-
mission having the right to acquire land for public purposes by
eminent domain proceedings, and any public or private utility com-
pany, railroad or other organization, body or agency having the
right to acquire land for a public purpose through the use of eminent
domain. THIS TERM SHALL NOT INCLUDE ANY POLITICAL
SUBDIVISION OTHER THAN BALTIMORE CITY OR ANY
AGENCY THEREOF, OR ANY BOARD OR COMMISSION WHEN
ACQUIRING PROPERTY FOR A PUBLIC PURPOSE AND SUCH
PURPOSE IS NOT WHOLLY OR PARTIALLY FINANCED BY
FEDERAL FUNDS.
(b) The term "Federal financial assistance" means a grant, loan
or contribution provided by the United States to the State of Mary-
land or any of its political subdivisions or agencies.
(c) The term "person" means any individual, partnership, corpo-
ration or association.
(d) The term "displaced person" means any person who, on or
after the effective date of this Act moves from real property, or
moves his personal property from real property, as a result of the
acquisition of such property in whole or in part, or as the result of a
written order of the acquiring agency to vacate real property for a
public works program or project undertaken by the Condemning
Authority.
(d) (E) The term "business" means any lawful activity, except-
ing a farm operation, conducted primarily—
(A) for the purchase, sale, lease and rental of personal and
real property, and for the manufacture, processing, or marketing of
products, commodities, or any other personal proerty PROPERTY;
(B) for the sale of services to the public; or
(C) by a nonprofit organization.
(f) The term "farm operation" means any activity conducted
solely or primarily for the production of one or more agricultural
