the planning and construction of school buildings or school capital
improvements, and any other requirements involving school con-
struction and capital improvements necessary or appropriate for the
proper implementation of this section. IN PRESCRIBING ANY OF
THE FOREGOING, IT SHALL BE THE PURPOSE OF THE
STATE BOARD OF EDUCATION AND THE BOARD OF PUBLIC
WORKS TO PROVIDE FOR THE MAXIMUM EXERCISE OF
INITIATIVE BY SCHOOL PERSONNEL IN EACH COUNTY
AND IN BALTIMORE CITY, TO INSURE THAT THE SCHOOL
BUILDINGS AND IMPROVEMENTS THERETO MEET THE
NEEDS OF THE LOCAL COMMUNITIES, WHILE AT THE
SAME TIME, MEETING SUCH REGULATIONS AS ARE NEC-
ESSARY TO INSURE THE PROPER OPERATION OF THIS
SECTION AND THE PRUDENT EXPENDITURE OF STATE
FUNDS. The obligation of the State to pay the costs of public school
construction and public school capital improvements shall extend
only to those projects or portions thereof which are in compliance
with the rules, regulations and procedures of the Board of Public
Works.

(e)    All money appropriated to accomplish the purposes of this
section, whether by Budget Bill or Supplementary Appropriation
Bill, shall constitute a separate fund which shall be administered by
the Comptroller in accordance with rules and regulations adopted by
the Board of Public Works.

(f)    The rules, regulations and procedures of the Board of Public
Works adopted pursuant to this section, and the promulgation there-
of, shall be exempt from Article 41 of this Code, Section 9 and Sec-
tions 244 through 256 inclusive, and Article 78A of this Code, Sec-
tion 2.

(g)    The authority, responsibilities, powers and duties of the
State Board of Education, the State Superintendent of Schools, the
governments of the counties and of Baltimore City, the local boards
of education, and all other State or local governmental agencies or
officials under the several sections of this Article, with respect to
public school construction or public school capital improvements,
including sites for school buildings, shall be subject to the rules,
regulations and procedures adopted by the Board of Public Works
pursuant to this section. In the event of any conflict between said
rules, regulations and procedures of the Board of Public Works and
the authority, responsibilities, powers and duties of the above-named
agencies and officials relative to public school construction or public
school capital improvements, the rules, regulations and procedures
of the Board of Public Works shall prevail.

(H) THE BOARD OF PUBLIC WORKS SHALL DEVELOP
THE RULES, REGULATIONS AND PROCEDURES AUTHOR-
IZED BY THIS SECTION IN CONSULTATION WITH REPRE-
SENTATIVES OF THE BOARD OF EDUCATION OF THE
SEVERAL COUNTIES AND THE BOARD OF SCHOOL COM-
MISSIONERS OF BALTIMORE CITY AND WITH REPRE-
SENTATIVES OF THE LOCAL GOVERNING BODIES. PRIOR
TO THE ADOPTION OF ANY RULE, REGULATION OR PRO-
CEDURE AUTHORIZED BY THIS SECTION, OR THE AMEND-
MENT OR REPEAL THEREOF, THE BOARD OF PUBLIC
WORKS SHALL GIVE NOTICE OF ITS INTENDED ACTION TO
