591 581. Milk Products Which May Be Sold.
The sale of raw milk for human consumption shall be prohibited
with exception of those producer-distributors in business and hold-
ing a permit on the effective date of this Law.
Only pasteurized milk products as defined by Law or Regulation
in this subtitle shall be sold to the final consumer, or to restaurants,
soda fountains, grocery stores, or similar establishments. Provided,
That in an emergency, the sale of pasteurized milk products which
have not been graded, or the grade of which is unknown, may be
authorized by the Secretary; in which case; such milk products shall
be labeled as stipulated by the Secretary. An emergency is defined
as a general and acute shortage of milk, not simply one or more
handler's or distributor's shortage.
582. Personnel Health.
No person affected with any disease in a communicable form, or
while a carrier of such disease, shall work at any dairy farm, transfer
station, receiving station, or milk plant in any capacity which brings
him into contact with the production, handling, storage, or transpor-
tation of milk products, containers, equipment, or utensils; and no
dairy farm, transfer station, receiving station, or milk plant oper-
ator shall employ in any such capacity any such person, or any person
suspected of having any disease in a communicable form, or of being
a carrier of such disease. Any producer, producer-distributor, or dis-
tributor of milk products, upon whose dairy farm, or in whose trans-
fer station, receiving station, or milk plant any communicable dis-
ease occurs, or who suspects that any employee has contracted any
disease in a communicable form, or has become a carrier of such
disease, shall notify the Secretary immediately.
No person with an infected cut or lesion on hands or arms shall
handle milk products, milk containers, or milk equipment.
To safeguard the public's interest, the Secretary may make or
require such reasonable medical and biological examination of all
persons suspected of any communicable disease and of their body
discharges.
583. Violations.
Any person found guilty of violating any provisions of this sub-
title, or any rule or regulation issued pursuant thereto shall, in addi-
tion to any other provisions of the laws of Maryland, be subject to a
fine in the discretion of the court, of not to exceed $100.00 for each
and every such offense, and a repetition of such offense may be
enjoined by appropriate proceedings in the courts of this State. It
shall be the duty of the State's attorney of each and every county of
this State and the City of Baltimore, upon application by the Secre-
tary, to prosecute in the court having jurisdiction of the offense, all
persons charged with the violation of any of the provisions of this
subtitle, both inclusive, of this subtitle, and where appropriate, to
institute proceedings in court to enjoin further such violations.
584. Severability.
Should any section, paragraph, clause or sentence of this subtitle
be declared unconstitutional or invalid for any reason, the remainder
of the said subtitle shall not be thereby affected.
