(4) thereof, to create a new alcoholic beverage license in Prince
George's County for luxury type restaurants designated as a Class
BLX license; to provide certain requirements for said license;
to set the license fee for said license; to provide for its issuance
by the Board of License Commissioners for Prince George's
County, to set forth certain limitations as to its use and relating
generally to the issuance of this new class of license in Prince
George's County.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 19(i)(5) be and the same is hereby added to
Article 2B of the Annotated Code of Maryland (1968 Replacement
Volume and 1970 Supplement), title "Alcoholic Beverages," subtitle
"Beer, Wine and Liquor Licenses," to follow immediately after Sec-
tion 19(i)(4) thereof and to read as follows:

(5) In Prince George's County there shall be, in addition to the
classes herein provided, a special Class B license known as Class
BLX which shall be issued only to luxury type restaurants; they
shall be applied for in the regular manner and shall have a license
fee of Nine Hundred and Forty ($940.00) dollars. A luxury type
restaurant shall be as defined by the Rules and Regulations of the
Board of Liquor License Commissioners for Prince George's County,
provided that said restaurant has a minimum capital investment of
$300,000.00 for dining room facilities and kitchen equipment, which
sum shall not include the cost of land, buildings or a lease, with
a minimum seating capacity of 150 persons. The Board of License
Commissioners shall have complete discretion as to whom these
licenses shall be issued, and the number to be issued except that
under no circumstances shall any individual or corporation be
allowed to hold more than one such license. This license shall be
limited and restricted to the purpose of providing alcoholic beverages
for consumption on the licensed premises only, with no off sale
privileges to be exercised therewith.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 535
(House Bill 442)

AN ACT to repeal and re-enact, with amendments, Sections 90(b)
and 104A of Article 2B of the Annotated Code of Maryland (1968
Replacement Volume and 1970 Supplement), title "Alcoholic Bev-
erages," subtitle "Hours and Days for Sale," to provide that for
Somerset County Sunday sales by Class B (on-sale) and Class C
(on-sale) beer, wine and liquor licenses shall be permitted between
certain hours UNDER CERTAIN CONDITIONS; and to have
another section conform to these provisions, and correcting errors
therein.
