Public Local Laws of Maryland), title "Cecil County," and to
enact new Sections 19-1, 19-2 and 19-2.1 in lieu thereof, to stand
in the place of the sections repealed, and to be under the new sub-
title "Department of Public Works"; and to repeal and re-enact,
with amendments, Sections 19-3 through 19-6 of the Code of
Cecil County, Maryland, and the same title and new subtitle;
and Section 19-7 (a), (b), (c) and (d); and Section 19-8; and
Section 19-9, as last amended by Chapter 39 of the Acts of 1970;
and Sections 19-10 through and including Section 19-24 of the
same title and subtitle, to abolish the Cecil County Metropolitan
Commission and creating the Department of Public Works, pro-
viding for its organization and functions, and changing all refer-
ences to the "Metropolitan Commission" to the "Department."

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 19-1 and 19-2 of the Code of Cecil County, Maryland
(1970 Edition, being Article 8 of the Code of Public Local Laws
of Maryland), title "Cecil County," be and they are hereby re-
pealed; that new Sections 19-1, 19-2, and 19-2.1 be and they are
hereby enacted in lieu thereof, to stand in the place of the sections
repealed, and to be under the new subtitle "Department of Public
Works"; that Sections 19-3 through 19-6 of the Code of Cecil
County, Maryland, the same title and new subtitle; that Section
19-7 (a), (b), (c) and (d); Section 19-8; and Section 19-9, as last
amended by Chapter 39 of the Acts of 1970; Sections 19-10 through
and including Section 19-24 of the same title and subtitle, be and
they are hereby repealed and re-enacted, with amendments, all to
read as follows:

[19-1.

(a)  For the purpose of carrying out the provisions of this chapter,
the sanitary districts created under the provisions of this chapter
shall be under the jurisdiction of a commission of three persons, all
of whom shall be appointed by the Board of County Commissioners
of Cecil County, and all of whom shall reside in Cecil County, be
resident taxpayers of said county and qualified voters thereof. No
person shall be eligible for appointment to said commission by the
board of county commissioners of Cecil County who shall hold any
elective or appointive office at the time of or during the period
immediately preceding such appointment. The term of each of the
three members shall be six years or until their successors are ap-
pointed and have qualified, except that the first commissioner named
by said board of county commissioners shall serve for two years,
the second for four years and the third for six years from the date
of their appointment, and as the term of each commissioner expires,
his successor shall be appointed by the Board of County Commis-
sioners of Cecil County. Any vacancy in the personnel of the com-
mission shall be filled by appointment by the Board of County Com-
missioners of Cecil County for the unexpired term.

(b)  The commission shall elect one of its members as chairman,
and shall appoint, discharge at pleasure and subject to the approval
of the Board of County Commissioners of Cecil County, shall fix the
compensation of the secretary-treasurer, a chief engineer, and such
engineering, legal, clerical and other personnel and help, as from
