[Nothing contained in this] This subtitle shall apply to explosives
while being transported upon vessels, vehicles or railroad cars, [or]
and while being held for delivery, [provided] unless such transpor-
tation [and] or delivery is subject to and in conformity with the
regulations prescribed by the [Interstate Commerce Commission]
United States Department of Transportation or United States Coast
Guard; and provided, further, that nothing in this subtitle shall
apply to the receipt, possession and use of signals required for the
safe operation of vessels, motor vehicles, railroad cars or aircraft,
by the operators of such vessels, motor vehicles, railroad cars and
aircraft.
Sec. 4. And be it further enacted, That if any provision of this
Act or the application thereof to any person or circumstance is held
invalid for any reason, the invalidity shall not affect the other pro-
visions or any other application of this Act which can be given
effect without the invalid provisions or application, and to this end
all the provisions of this Act are declared to be severable.
Sec. 5. And be it further enacted, That this Act is hereby de-
clared to be an emergency measure and necessary for the immediate
preservation of the public health and safety and having been passed
by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.

AN ACT to repeal Sections 15 through 25 of Article 38A of the
Annotated Code of Maryland (1965 Replacement Volume and 1969
Supplement), title "Fires and Investigations," subtitle "Fire-
works," and to enact new Sections 15 through 25 in lieu thereof,
to stand in the place of the sections repealed, revising the laws
pertaining to the manufacture, use, sale, display, possession and
storage of fireworks, establishing licensing procedures, setting
out safety requirements, providing for promulgation of further
regulations, providing penalties for violations of this subtitle and
regulations issued hereunder, and relating generally to fireworks
in the State of Maryland.
Whereas, There have been several explosions in fireworks plants
within the State; and
Whereas, These accidents have also caused much loss of life, many
serious injuries to persons, and damage to property; and
Whereas, This loss of life and damage is a matter of grave con-
cern; and
Whereas, The continued operation of fireworks plants in an unsafe
manner constitutes a serious threat to the public safety and welfare;
and
