119.

Every person, his aiders or abettors, who shall wilfully and mali-
ciously dynamite, blow up or otherwise, by means of any explosives
as that term is defined in Section 26(a) of Article 38A of this Code,
wreck, destroy, injure or damage, in whole or in part, or attempt so
to do, or conspire or connive thereat, any [of the] property whether
real or personal, public or private,
[hereinafter mentioned,] shall
be guilty of a felony, and shall be subject, in the discretion of the
court,
to imprisonment for [a term] life or for a definite period not
exceeding twenty years, or to a fine not exceeding [ten] twenty
thousand dollars, or to both fine and imprisonment, in the discretion
of the court [; provided, however, that nothing in this section or
Section 120 of this article shall apply to the crime of arson or any
prosecution therefor].

Sec. 2. And be it further enacted, That Section 120 of Article 27
of the Annotated Code of Maryland (1967 Replacement Volume),
title and subtitle, "Crimes and Punishments," subheading "Destroy-
ing, Injuring, Etc., Property Maliciously," be and it is hereby re-
pealed.

Sec. 3. And be it further enacted, That Sections 27, 28, 29, 31,
32(C), 33, 34 and 35 of Article 38A of the Annotated Code of Mary-
land (1965 Replacement Volume), title "Fires and Investigations,"
subtitle "Explosives," be and they are hereby repealed and re-enacted,
RE-ENACTED with amendments, and that a new Section SEC-
TIONS 27A and 27B be and it is THEY ARE hereby enacted as part
of the same Article, title and subtitle, to follow immediately after Sec-
tion 27 thereof, AND THAT A NEW SECTION 31A BE AND IT
IS HEREBY ENACTED AS PART OF THE SAME ARTICLE,
TITLE AND SUBTITLE TO FOLLOW IMMEDIATELY AFTER
SECTION 31 THEREOF, AND THAT A NEW SECTION 33A BE
AND IT IS HEREBY ENACTED AS PART OF THE SAME AR-
TICLE, TITLE AND SUBTITLE TO FOLLOW IMMEDIATELY
AFTER SECTION 33 THEREOF, and that new Sections 34A, 34B,
34C, 34D, 34E, and 34F 34F AND 34G be and they are hereby en-
acted as part of the same Article, title and subtitle, to follow im-
mediately after Section 34 thereof, and all to read as follows:

27.

No person shall manufacturer [possess] hand manufacture or
deal in explosives unless he has obtained a license [therefor] for
such manufacture, hand manufacture, or dealing
pursuant to the
provisions of [Section 23] subsection (a) or (b) of Section 28 of
this subtitle.

27 A.

No person shall possess ANY explosives OTHER THAN SMOKE-
LESS POWDER AND EXPLOSIVES NECESSARY FOR THE
MANUFACTURE OF AMMUNITION FOR SMALL ARMS unless
he has obtained a license to manufacture, hand manufacture, deal in
or possess SUCH explosives pursuant to the provisions of Section 28
of this subtitle. The presence of explosives in any vehicle shall be
evidence of the possession of the explosives by each person occupy-
ing the vehicle in which the explosives are
found.
