173.

(a) The present State boiler inspectors shall be retained in office
by reason of their having passed the competitive State of Maryland
boiler inspector's examination given by the State Commissioner of
Personnel or his successor. At any time hereafter when the office
of chief boiler inspector or deputy boiler inspector shall become
vacant, the Commissioner of Personnel or his successor shall, as
soon as practicable, conduct a competitive examination in accord-
ance with State Merit System Law, the examination to be the same
or equivalent to the examination given by the Board of Boiler
Rules for special inspectors in Section 174 of this subtitle. The
Commissioner of Labor and Industry with the approval of the
Secretary of Licensing and Regulation,
shall appoint from the suc-
cessful candidates a chief boiler inspector or a deputy boiler inspec-
tor, as the case may be.

Sec. 23. And be it further enacted by the General Assembly of
Maryland,
That Section 11-3. of the Code of the Public Local Laws
of Baltimore City being Article 4 of the Code of Public Local
Laws of Maryland (1969 Edition), title "Article 4—Code of Public
Local Laws of Maryland," subtitle "Moving Picture Machine Op-
erators," be and it is hereby repealed and reenacted, with amend-
ments, to read as follows:

11-3.

The Governor, with the advice of the Secretary of Licensing and
Regulation,
shall biennially appoint in and for Baltimore City three
persons: one from the Maryland Fire Underwriters' Rating Bureau,
one licensed motion picture machine operator, a member of the
Moving Picture Operators' Union, and one exhibitor duly licensed
to operate motion picture machines; all of whom have had not less
than three years' experience at the business and who have resided
in Baltimore City for a period of not less than two years next
preceding their appointment, who shall be known as the Board of
Examining Moving Picture Machine Operators. The Board of Exam-
ining Moving Picture Machine Operators shall be a part of the
Department of Licensing and Regulation.
The parties so appointed
shall make oath before the Clerk of the Superior Court that they
will faithfully perform the duties of their office, and shall give bond
in the sum of five hundred dollars, to be approved by the Judge of
the Superior Court of Baltimore City. The exercise or performance
of all powers, authority, duties and functions vested in the Board
by the provisions of this subtitle, shall be subject to the power and
authority of the Secretary of Licensing and Regulation as set forth
in Article 41 of the Annotated Code of Maryland, or elsewhere in
the laws of this State.

Sec. 24. And be it further enacted by the General Assembly of
Maryland,
That Section 4-1. of the Code of the Public Local Laws
of Baltimore City being Article 4 of the Code of Public Local Laws
of Maryland (1969 Edition), title "Article 4—Code of Public Local
Laws of Maryland," subtitle "Examining Engineers," be and it is
hereby repealed and reenacted, with amendments, to read as follows:
