Fire Prevention Commission shall, with the approval of the Secretary
of Public Safety and Correctional Services, appoint a State Fire
Marshal for a six-year term. He is not subject to the provisions of
Article 64A of this Code, but he can be removed by the Commission,
with the approval of the Secretary of Public Safety and Correc-
tional Services, at any time for neglect of duty, or other conduct
unbecoming his office. Prior to removal, he shall be given timely
notice by the Commission with a statement of the charges against
him with an opportunity in person or by counsel for a public hearing
thereon. Initially the salary of the State Fire Marshal shall be not
less than that of the assistant fire marshal, immediately prior to
July 1, 1964. The State Fire Marshal shall be appointed in accord-
ance with the following qualifications: (1) Graduation from an
accredited college or university, with specialized study in either the
field of fire protection or engineering, and (2) five years of recent
progressively responsible experience in fire prevention inspection,
fire investigation, fire safety promotion, fire protection engineering,
teaching fire safety engineering, or fire fighting, three years of which
must have been at the administrative level.
Sec. 7. And be it further enacted, That Sections 126, 127 and
188C of Article 41 of the Annotated Code of Maryland (1957 Edition,
1965 Replacement Volume and 1969 Supplement), title "Governor—
Executive and Administrative Departments," subtitles "The Execu-
tive Department," "Department of Parole and Probation" and
"Coordinating Council For Correctional Services," be and they are
hereby repealed in their entirety, and that Sections 70A(b), 70A(c),
70A(d), 108(a), 108(b), 115, 188A(a), 188A(b), 188A(d) and 229 of
the same Article, title "Governor—Executive and Administrative
Departments," subtitles "The Executive Department," "Police Train-
ing Commission," "Board of Parole," "Department of Parole and
Probation," "Sundry Claims Board," and "Traffic Safety Commis-
sion," be and they are hereby repealed and re-enacted, with amend-
ments, all to read as follows:
70A.
(b) There is hereby established in the [Executive] Department
of [the State of Maryland,] Public Safety and Correctional Serv-
ices, a Police Training Commission whose membership shall consist
of the following [ten] persons:
(1) The president of the Maryland Chief of Police Association;
the president of the Maryland Law Enforcement Officers, Inc.; the
Attorney General of the State of Maryland; the Superintendent of
the Maryland State Police; the commissioner, Baltimore City police
department; the president of the University of Maryland; the agent
in charge of the Baltimore office of the F.B.I.; the Deputy Secretary
of Public Safety and Correctional Services for Public Safety; and
three police officials of the State to be appointed by the Secretary of
Public Safety and Correctional Services, with the approval of the
Governor, and with the advice and consent of the Senate, to represent
the State geographically, the appointments to be made for a three-
year term provided that, for the first term, one official shall be
appointed for a term of one year, one for a term of two years, and
one for a term of three years.
