the pleasure of the Commissioner and shall not be subject to the

provisions of Article 64A of this Code. He shall be a person with

knowledge in the correctional field. The assistant commissioner, sub-
ject to policy of the Division of Correction as established from time
to time by the Commissioner, shall be
generally charged with direc-
tion of specific correctional programs. In the absence of the Commis-

sioner and the deputy commissioner, the assistant commissioner shall
be acting commissioner.

(f) The [Department] Division of Correction shall submit an-
nually to the Governor [and the Budget Director] , to the Secretary
of Public Safety and Correctional Services and to the Secretary of
Budget and Fiscal Planning
a complete financial report and pro-
gram of the operation of State-use industries and of the so-called
State-Use Industries Fund, in the same general manner and form as
for the other operations and programs of the [Department] Division
of Correction, including full information as to present and projected
personnel and their compensation; and the Governor and [Budget
Director] the Secretaries shall include data and figures from the
report and program of State-use industries and of the State-Use
Industries Fund in the preparation of the budget and of the capital
improvement bill.

Sec. 5. And be it further enacted, That Sections 1(a), l(b), 1(c),
2 and 4(a) of Article 31B of the Annotated Code of Maryland (1957
Edition, 1967 Replacement Volume and 1969 Supplement), title
"Defective Delinquents," subtitle "Patuxent Institution," be and they
are hereby repealed and re-enacted with amendments, all to read as
follows:

1.

(a)    There shall be an institution for defective delinquents, with
the powers and duties as provided in this article or elsewhere in the
laws of this State. Said institution shall be established at Jessup
[and], shall be known as the Patuxent Institution and shall be part
of the Department of Public Safety and Correctional Services.

(b)    [The] Subject to the authority of the Secretary of Public
Safety and Correctional Services as provided for in Article 41 of this
Code or elsewhere in the laws of Maryland, the
board of Patuxent
Institution shall possess all of the powers bestowed by law upon
Patuxent Institution, [and] The Board shall consist of the chair-
man of the board and four associate members, who shall be appointed
by the [Governor] Secretary of Public Safety and Correctional
Services, with the approval of the Governor and
with the advice and
consent of the Senate. Two of the associate members shall be ap-
pointed from the membership of the advisory board of Patuxent
Institution, and one of these two associate members shall be a psy-
chiatrist. The chairman and associate members of the board shall
serve terms of four years, except that the initial term of the asso-
ciate members first appointed to the board shall be one, two, three
and four years respectively. Any vacancy in the board shall be filled
by appointment of the [Governor,] Secretary of Public Safety and
Correctional Services, with the approval of the Governor, and
with
the advice and consent of the Senate, for the unexpired term. The
