CHAPTER 326
(House Bill 106)

AN ACT to repeal and re-enact, with amendments, Section 410 of
Article 27 of the Annotated Code of Maryland (1967 Replacement
Volume), title "Crimes and Punishments," subtitle "Murder," pro-
viding that all murders committed in the perpetration of, or at-
tempt to perpetrate a kidnapping, storehouse breaking, and day-

time house breaking shall be classified as murder in the first

degree; and providing further for the application of this Act CER-
TAIN CRIMES SHALL BE MURDER IN THE FIRST DEGREE.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 410 of Article 27 of the Annotated Code of Maryland
(1967 Replacement Volume), title "Crimes and Punishments," sub-
title "Murder," be and it is hereby repealed and re-enacted with
amendments, and to read as follows:

410.

All murder which shall be committed in the perpetration of, or
attempt to perpetrate, any rape, sodomy, mayhem, robbery, burglary,
kidnapping, storehouse breaking, and daytime house breaking AS
DEFINED IN SECTIONS 337 AND 338 OF THIS ARTICLE,
STOREHOUSE BREAKING AS DEFINED IN SECTIONS 32 AND
33 OF THIS ARTICLE, OR DAYTIME HOUSE BREAKING AS
DEFINED IN SECTION 30(B) OF THIS ARTICLE, or in the
escape or attempt to escape from the Maryland Penitentiary, the
House of Correction, the Baltimore City jail, or from any jail or penal
institution in any of the counties of the State, shall be murder in
the first degree.

Sec. 2. And be it further enacted, That nothing in this Act shall
apply to or affect the prosecution of any act or criminal offense
occurring prior to the effective date of this Act.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 327
(House Bill 137)

AN ACT to repeal and re-enact, with amendments, Section 30 of
Article 5 of the Annotated Code of Maryland (1968 Replacement
Volume), title "Appeals," subtitle "Appeals From Justices of the
Peace," to provide for the removal of motor vehicle causes from
the type of causes which may be appealed to the circuit court of
the county by any party from any judgment of a justice of the
peace.
