(3) practice as a nursing home administrator or use in connec-
tion with his name any designation tending to imply that he is a
nursing home administrator unless licensed and registered so to
practice under the provisions of this subtitle, or

(4) otherwise violate any of the provisions of this subtitle.

(b) Any person convicted of violating any of the provisions of
this subtitle shall be fined not more than one hundred dollars for the
first offense. Each subsequent offense shall be punishable by a fine
of not more than five hundred dollars, or by imprisonment of not
more than six months, or by both such fine and imprisonment.

765.    Emergency Performance.

If a licensed nursing home administrator is removed from his posi-
tion by death or other unexpected cause, the owner, governing body,
or other appropriate authority of the nursing home may designate
an acting nursing home administrator who may serve without a
license for no more than 90 days, unless an extension is granted by
the Board, for a period which may not exceed an additional 30 days.

766.    Separability Clause.

If any section or provision of this subtitle is declared unconstitu-
tional or void by any court of competent jurisdiction, or the applic-
ability thereof to any person or circumstances is held invalid, the
constitutionality or validity of the remainder of the subtitle and the
applicability thereof to other persons and circumstances shall not be
affected thereby, and to this end the sections and provisions of this:
subtitle are declared to be severable.

767.    Provision of Funds.

Funds for carrying out the provisions of this subtitle shall be as
provided in the State Budget. For the fiscal year beginning July 1,
1970, such funds shall be as provided in the Supplemental State
Budget. Organizational and other expenses incurred by the Board in
the performance of duties prior to July 1, 1970, shall be reimbursed
from State funds.

768.    Short Title.

This subtitle shall be known and may be cited as the "Nursing
Home Administrators' Licensing Act."

Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate preser-
vation of the public health and safety and having been passed by a
yea and nay vote supported by three-fifths of all the members
elected to each of the two houses of the General Assembly, the same
shall take effect from the date of its passage.
